On March 3, 2010, the VDOE received a petition to reopen the Regulations Governing Educational Services for Gifted Students for an additional 30-day comment period. Below is the official TownHall notification.
 
Start of Town Hall Notification:
The Final stage has been suspended for the following regulation.
Board: State Board of Education
VAC Reference: 8 VAC 20 - 40
 
Action: Revision of the Regulations Governing Educational Services for Gifted Students
 
Reason for suspension: The final stage is suspended pursuant to Section 2.2-4007 of the Code of Virginia. The agency will hold an additional 30-day comment period beginning on March 29, 2010, and ending on April 28, 2010. Written comment may be submitted by US mail, e-mail, or fax to: Dr. Donna Poland, Virginia Department of Education, P.O. Additional Information Received from Dr. Donna Poland, Department of Education
I want to provide you with a possible scenario that may follow in the coming months . . . please note that this could be subject to changes throughout depending on the actions of the VBOE and the 30-day comment period:
 
1. Following close of comment period on April 28, 2010, the final regulations will be voted on again by the Virginia Board of Education (VBOE), noting any changes as a result of additional comment. The earliest this item can go before the VBOE is at the May 27 board meeting.
 
2. The final regulations will then be submitted directly to the Register for final publication.  This will be an exempt action; thus does not need to go through the executive review process.
 
3. Assuming the Board does final adoption on May 27, the final Regulations will be published in the Register on June 21, 2010 (which could possibly not post until July 1), and will become effective after a 30-day comment period following the posting date. If a petition is not received during this 30-day comment period, the regulations will go into effect.
