Can you please discuss about below mentioned points related to Trademark ?
1. Is the Trademark Registration compulsory as per TM act? Or registration is only Advisable? Please provide provisions and relevant citations or sections or circulars of Law. Please elaborate the legal definition of Advisable.
a. Is any circular or Provision we get which says once application made applicant can use trademark ? And after approval "TM" becomes "R"
2. Which date can be considered as the registration date of TradeMark?
3. TM registration process takes almost 18months to 24months. After filing the Application of Trademark, can we use ‘TM’ sign besides logo? .
4. Is the registration of the TradeMark mandatory to apply for government tenders?
5. If TradeMark Act says the Registration is not compulsory then any Government office like PWD does have right to make the registration of TM compulsory?
