RESOLUTION
We, Cambodian people throughout the World, were convinced that the Paris Peace Agreement on Cambodia of October 23, 1991, with "International Guarantees" provision, would provide us with hope, peace, justice, security, dignity, freedom, respect for human rights and respect for sovereignty, independence, territorial integrity and inviolability, neutrality and national unity of Cambodia. If this Agreement was fully implemented, Cambodia would be free from all foreign interference and coercion, consistent with the principles and purposes of this Agreement as well as those of the United Nations.
Whereas, the Paris Peace Agreement on Cambodia of October 23, 1991 has not been fully and properly implemented, especially with regard to the respect for the sovereignty, independence, territorial integrity and inviolability, neutrality and national unity of Cambodia as stipulated in Article 18, Part IV: International Guarantees of this Agreement on a Comprehensive Political Settlement of the Cambodia Conflict and other relevant provisions. Certain acts, facts and events evidence that the neighboring signatory countries -- Vietnam and Thailand -- violate the aforesaid Agreement and previous international treaties, conventions, agreements and accords;
Whereas, the illegal treaties and agreements of 1979, 1982, 1983 and 1985 that were imposed by the Vietnamese armed forces during their invasion and occupation of Cambodia are in violation of the sovereignty and territorial integrity of Cambodia as they were not terminated as they should have been as specified in Article 1:2:d) of the Paris Peace Agreement. The fact that these treaties and agreements were recently reaffirmed and ratified by the government of Cambodia and the government of Vietnam in October 2005, evidences an attempt to legalize these illegal and illegitimate treaties and agreements mentioned above and constitutes a clear and serious violation of Article 5:1:, 2: and 3: of the Paris Peace Agreement requiring all parties, including Cambodia, to take steps to rectify the situation into full compliance with this Agreement. These actions by the government of Cambodia and the government of Vietnam were made without giving the Cambodian people the opportunity to freely debate the issues, indicating that the present regime in Cambodia is not truly independent from the Vietnamese communist government, which itself is in violation of the Paris Peace Agreement;
Whereas, the incessant and unfettered, massive illegal Vietnamese immigration into Cambodia for over two decades, has called Cambodia's sovereignty into serious question. Compared to native Cambodians, these illegal Vietnamese immigrants are treated by the Cambodian administration with generous leniency, and have been allowed to break the laws of Cambodia with impunity.
To the detriment of the native Cambodian population, these illegal Vietnamese immigrants continue to flow into Cambodia in large numbers, driving Cambodians out of their dwellings and pagodas, from their farms, rice fields and plantations. These illegal immigrants, through 19 powerful associations established under the influence of the Vietnamese authority, are granted more rights than native Cambodian people living in their own country. These illegal immigrants do not report to Cambodian authority as they should under international norm, rather they report directly to the Vietnamese embassy in Phnom Penh. This fact points out the lack of independence of local and national authority, and more seriously, the lack of respect for the sovereignty of Cambodia on the part of Vietnam. For example, in Chak Angre Loeu, Vietnamese immigrants chased the Cambodian monks out of their temple. The number of illegal Vietnamese immigrants has increased to the alarming level of 33% of the present total population of Cambodia and continues to increase considerably every day;
Whereas, the agreement between the Cambodian, Laotian and Vietnamese administrations creating the "Triangle of Development" zone composed of three provinces of Cambodia (Stung Trèng, Ratanakiri and Mondulkiri, representing 20% of Cambodia's land area), three provinces of Laos (Attapeu, Sékong and Saravan) and four provinces of Vietnam (Gia Lay, Kon Tum, Dac Lac and Dac Nông) was created under the guise of improving the standard of living of the people (200,000 Cambodians, 500,000 Laotians, and 6,100,000 Vietnamese) in this zone. However, it is in fact a camouflaged neocolonization scheme that will mainly benefit Vietnam in the context of the de facto master plan of creating an Indochinese Federation under the strict control of the Vietnamese armed forces;
Whereas, there are an increasing number of unpalpable interferences from Vietnam into Cambodia's affairs, treating the Cambodian regime as its subordinate and subservient; for example in the case of the Venerable Tim Sakhorn, a Cambodian Monk living in the pagoda of Phnom Den of Takeo province of Cambodia. The Cambodian government was instructed to arrest the Venerable Tim Sakhorn and hand him over to Vietnam to be imprisoned without having any rights of defense. He is being subjected to many deprivations similar to the treatment of many Khmer Krom monks in the southern provinces of Vietnam. The Vietnamese have ignored the various protests and solidarity demonstrations of the Khmer communities held in the United States of America, France, Australia and other countries, calling for the release and safety of the Venerable Tim Sakhorn and all other monks that have been arrested and imprisoned;
Whereas, Mr. Son Chhay, Member of Parliament of the National Assembly of Cambodia, recently revealed the secret granting of a long-term land concession by the Cambodian administration to Vietnam without proper procedures. This concession amounts to 100,000 hectares (247,000 acres) for the cultivation of rubber trees ( Hevea) distributed throughout the provinces of Mondolkiri, Kratié, Stung Trèng, Kompong Thom and Preah Vihear, and was granted with the full knowledge that it will be managed by the Vietnamese military and its labor forces. Furthermore, an exclusive tourism operation concession-right to the famous and revered Angkor Wat Temple, a world inheritance site and the pride for all Cambodians, was also granted to the Vietnamese. These are just some facts to indicate that many key areas of the Cambodian national economy, including Cambodian hydrocarbon resources, are being exploited by the Vietnamese; and
Whereas, the human rights abuses, the loss of sovereignty, independence, and territorial integrity and inviolability, and because of the inherent interference by Vietnam in the political, economic, social, cultural and internal affairs of Cambodia through its subjugated Cambodian administration, the governments of Vietnam and Cambodia are in direct violation of the guarantees and clauses expressly stipulated in the Paris Peace Agreement on Cambodia of October 23, 1991.
Therefore, be it resolved that the worldwide participants of the Cambodian National Conference 2007 adopted resolutions to:
(A) Launch a solemn appeal to the world, the high institutions, the competent international jurisdictions, and the signatories of the Paris Peace Agreement on Cambodia of October 23, 1991, in particular the Co-presidents, to agree to reconvene and institute an ad-hoc committee to:
(1) investigate and report violations, and
(2) ensure the full compliance and respect of the 1991 Paris Peace Agreement by neighboring signatory countries, and by Vietnam's client Cambodian administration.
Only the full compliance of this Agreement will allow the Cambodian people to have their fundamental freedom to exercise their rights in a true democracy without any interference from its immediate neighbors, to promote and nurture real peace and durable stability among peoples in the region.
(B) Launch a solemn call to all Khmer communities in the Kingdom of Cambodia and abroad, including all political parties, to preserve our national existence and unity by calling for a full compliance by all parties concerned with regards to the implementation of the Paris Peace Agreement of 1991; especially in respect to the portion of this Agreement concerning the sovereignty, independence, territorial integrity and inviolability, neutrality and national unity of Cambodia. Khmer people must assume the ultimate challenge to safeguard and develop our Khmer Nation to the level it deserves among free, prosperous and democratic people.
