Since Utah and Kessler not close to an agreement on a contract, and if we were able to find a way to get him interested in Boston, is it permissible to offer Utah some picks not to match their offer? (Thats assuming we have the capital to sign him).

We can only sign him to an offer sheet worth the mid-level exception. But there's no reason the Jazz couldn't send him to us in a sign and trade if he's willing.

I should have been clearer.  A sign and trade would be great if its do-able. But just say we had enough to sign him outright, is it legal to give away a pick or 2 for them not to match the offer?

FYI – sign-and-trade IN sets a first-apron hard cap. The Simons TPE could be the starting point if Kessler was open to that figure, but the team would have a set limit in payroll all year to get to 14 players.

Not exactly, but they could match the offer and trade him to you for the picks, which would amount to the same thing.
