I got this from the ministry of health, i don't believe its on their website but you have to get it by request. It's a little long, but I'm trying to familiarize myself with it. I can see already that it doesn't answer all question, so I ask that if you communicate with the ministry of health and get an interesting answer that could help others, please post it here.


In regards to termination of the agreement... YIKES! 

(5) If this Agreement is terminated under section 9(1) or (2), the Participant shall

repay to the Ministry, in Canadian currency, the Repayment Amount and interest

on the Repayment Amount.

10. (1) The Repayment Amount shall consist of the following:

(a) the administrative costs paid on behalf of the Participant by the Ministry,

up to $4000;

(b) the training costs paid on behalf of the Participant by the Ministry of Health

and Long-Term Care and by the Ministry of Training, Colleges and

Universities;

(c) the full salary for each year of his or her Post-Graduate Medical Training,

provided to the Participant by the Ministry, at the rate specified in the

PAIRO Agreement, as it exists from time to time during the Participant’s

Post-Graduate Medical Training; and

(d) benefits for each year of his or her Post-Graduate Medical Training,

calculated as 10% of the full salary as described in clause 10(1)(c).

I'm working on schemes, I need a lawyer that's for sure, some of this just seems ridiculous, for the most part is reads as 

"So whatever we say goes, and if you don't like you it can pay lots of money, and interest on that, and more money, and some other fees, cause we are almighty and very powerful"

You'll definitely need a lawyer. But I would suggest you get in touch with one now at least to tell you whether it will be feasible or not.

Hi Phil,

I agree with Shiraz. The terms seem pretty dictatorial but I don't know if they have actually been contested previously. I think before you let the College know that you are planning to pursue this, if at all, make sure you have all grounds covered and know for sure the feasibility of the claim. For all of that, you would need a good lawyer so I would encourage that too.
