Hello CDLI Colleagues - 

It's been awhile! On behalf of the CDLI Secretariat, I'd like to invite those interested in discussing controlled digital lending to join us for an upcoming session with Kyle Courtney, which is described below.  After Kyle's talk, we'd love to hear from you with any updates you can share from your own experiences, and feedback on whether you'd like to continue convening on this topic. We're of course aware that the environment has shifted and this group may benefit from some re-framing in order to have constructive conversations. We will not be recording this call, as has been our practice, however, we will share any anonymized notes/information presented that we have permission to share.

Topic:  The Reports of CDL's Death are Greatly Exaggerated: A Talk on Hachette v. Internet Archive ("The CDL Case")

📚 The United States Court of Appeals for the Second Circuit determined that the Internet Archive's (IA) digital loaning program, called “Open Libraries,” was not a fair use. The court found that the program violated the copyrights of several major book publishers. IA's Open Libraires system had utilized their own variety of controlled digital lending (CDL) to make their collections available for digital loans. After this decision, what is the impact on libraries and archives working to increase access to their collections for their patrons? 🤔

Join us for an insightful (and fun!) discussion with Kyle K. Courtney, Director of Copyright and Information Policy, member of CDLI's Secretariat, and co-author of the original "White Paper on Controlled Digital Lending of Library Books," Kyle will break down the recent court decision, and share thoughts on what the future holds for CDL in the U.S. and beyond.
