如委由出版社合作出版公開取用圖書，合約敘明

 The work shall be distributed under the terms of the Creative Commons Attribution 4.0 International License, which permits use, duplication, adaptation, distribution, and reproduction in any medium or format, as long as appropriate credit is given to the original author(s) and the source, a link os provided to the Creative Commons lincence and any changes mande are indicaed.

且合約中授予出版社印製紙本書之權利，這樣是不是有矛盾??

或是任何人都可以印製?

您好，

有幾項要求供知悉：

1、CC授權是「對公眾」皆產生同一效力的公眾授權條款，也就是能接觸到作品的人，只要能依循CC授權預設的條件要求來實踐義務，則任何人皆可依條款行使相關被授權的權利；
2、CC授權條款的條款內容不能被異動修改，以CC-BY-4.0為例，於第2條a項第5款之B明註：「您不得就本授權素材提出或加入任何額外或不同的條款或條件，若如此做會限制本授權素材的任何接受者行使本授權權利。（You may not offer or impose any additional or different terms or conditions on the Licensed Material if doing so restricts exercise of the Licensed Rights by any recipient of the Licensed Material.）」

所以說，依照您的簡要描述，似乎是：

1、該書籍將採CC-BY-4.0發布；
2、與出版商合約裡，註明出版社有紙本印製該書的權利。

前列「2、」為您與出版商之間的契約協議，不會無效，然只要是該書紙本出版時，或電子格式發布時，上列有CC-BY-4.0的授權指示，則所有取得書籍內容之人，皆依CC-BY-4.0，有地位自行重製、散布、改作、公開演播該書籍，不受您與出版商內部協議的限制。
