Greetings senate president colleagues,

We've recently discovered that at least a couple of our faculty are teaching fulltime at 2 different institutions. In one case they're doing so at 2 CCCs, in the other case they're doing this at institutions here and in New York - in person there.

I acknowledge that this is a working condition issue, and thus in the purview of our contract and collective bargaining agent. That said, we are curious to know if this is a common practice at other California Community Colleges, or if there is contractual language at yours that speaks to this issue.

Those of us who have learned of this are concerned that students are probably not getting the best of educations from instructors doing this. We are also aware that one of them has cancelled numerous classes, and the other has missed more than a full semester of service on a very important shared governance committee.

I do not want to disclose which department this is, but I will say that it's a newer department, the administrator over it has changed multiple times, and the chair has changed as well several times. All the faculty in the department (5) are in tenure review still. The department is crucial to student success.

We're interested to know what others in our system think about this and if you've got contractual language that speaks to it. Thank you in advance for any perspective you are inclined to share.

With appreciation,

Nancy

Not good. It seems like your administration needs to get a handle on this. In addition to the tenure review process and evaluation process for tenured faculty, this section of Ed Code addresses dismissal in general: https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=EDC&sectionNum=87732.

At my college, years ago, we had someone that was full time in my district and full time in another district.  This went on for about 3-4 years until there was a change in how we wanted the position in my district handled - this was a DE position.  And many people in my district also teach at the local CSUN as adjuncts and full time in my district.
We also have many full timers that live out of state and teach 100% online.  Don't know how long that is going to last and how equitable it is.  One of them lives on the east coast and is a full timer at my college and is teaching at another college on the east coast.  I am sure one day it will come to an end....I suppose those living out of state will have to move back to California.

Hi Nancy,

Our college actually has a BP prohibiting district employees from living out of state unless they are part of study abroad.  I’ve attached it here.  Our VP of HR told us that the college’s insurance won’t cover folks who live outside California so you may want to inquire with your HR folks about that.

We also have language in our contract prohibiting FT faculty from being employed FT at any other district.  I’ve included a link to our contract below, look at Article 6 section 2d on page 16.

Hope this helps.
