Colleagues,
So I've got an issue that I'm not sure is a Senate one. I received
an e-mail with the following question:

"ISSUE:
Can a Division Dean late-add a student into an instructor’s course
without consulting the Instructor?

QUESTIONS:
1. Who has the right to add students to a course after the first
day of class?
2. Does an instructor have an obligation to add students after
classes have begun [is there a requirement, in our handbook or other
writing, that instructors must add to the max enrollment of the class
after the first day of class]?
3. Can any dean add students to any instructor’s class after the
first day of class without consulting or informing the instructor?
4. What happens if a dean adds students and the adds result in
the class being filled over max?
5. What are the proper procedures and proper chain-of-command
for filing a timely complaint if this act by the dean qualifies as a
violation of Board Policy 4100 or any other grievable violation?"

I can see that there are some issues that are clearly for the Union...
say questions 2 and 5. But, in general, what is the senate's (my)
role in this?

I don't believe that a Dean can late-add a student without consulting
the instructor or that an instructor must add a student to a class
after the first day of class, even if the class is not full. At the
same time, the instructor should want to have a full class, as allowed,
particularly if the student adding is not starting too late to master
the course material. I'd be curious to see if others disagree with me.

They definitely cannot add a student in our district (Yuba CCD) after the first week without instructor approval, but they can within the first week (for full semester-length classes).  I don't know if this is a district policy or an issue covered under title 5.

§ 58507. Program Changes.
A community college district may allow a student to add or drop
classes during the term pursuant to district policy. The enrollment
fee shall be adjusted to reflect added or dropped courses as allowed
by district policy.

Thus it is a locally determined process, one which can be negotiated
by both the bargaining agents and the senates.

Issues:
Faculty would prefer to have it negotiated for all classes with maybe
the number determination to be established by the senate or department
faculty based upon equipment, facilities and pedagogy.

Admin feel that productivity (ratio of FTES to FTEF) is the fiscal
life blood of survival for the institution and want some control of
that.

Both are laudable goals and they do tend to contradict one another
