Reporting a near miss??

Howdy,

I was nearly (deliberately) hit by a garbage truck driver this morning
on the ride in to work. Does anyone have any advice on whether this is
worth reporting to police, BQ, someone else? And if so, who to
contact?

I'd like to know too. I was side swiped and knocked off by a car on the way to work a month ago. No major damage luckily, just skin off. My attempts to find a reporting mechanism were unsuccessful, and reporting to the Police appeared to be a fruitless waste of time. Maybe I am wrong? Any advice?

It is best to report to the police at a station in person. Remember it is your word against theirs without witnesses and the police will try and put you off reporting it but if you are serious keep insisting and indicate you will go to court if necessary. Registration plate numbers are critical in these situations and witnesses if possible. As one incident involved a garbage truck it might be worth ringing the council line 34038888


This is off BQ's website not sure if QPrime is still used but they have a system in place. Don't be surprised if nothing much happens.

Reporting Dangerous Drivers

Cyclists who suffer dangerous or deliberate intimidation by drivers are encouraged to make complaints to the Qld Police Service about dangerous drivers as well as hot spots where dangerous driving behaviours have been observed.
The Queensland Police Service (QPS) now uses a software system called QPRIME to record and action traffic complaints. The system, which went live in May 2006, replaces the TRACs system. The new system essentially links all entities to the complaint such as informants, occurrence addresses and suspect persons and vehicles. The system accommodates generalised complaints such as speeding or hooning activity as well as specific type complaints.The new system enables police to improve analysis and detection in the traffic complaint area especially with repeat offenders and direct resources where they are needed the most.
If a person wants to make a traffic complaint they can phone their local police station, although sometimes a personal visit to the station is required in order to verify the informant’s details. The informant’s details are recorded onto QPRIME along with the location of the complaint and any suspect and vehicle. All information recorded onto QPRIME is confidential and informants are not identified to any other party. An electronic task is created to a supervisor to check the complaint details and the traffic complaint is detailed to an officer to action. Enforcement may take place over a period of days or even weeks and Officers are required to continually update action taken by electronically updating reports attached to the complaint.
When you make a traffic complaint ask to be given the QPRIME number. This number is generated by QPRIME can be given to you later, even by telephone or email. The number will enable police anywhere in Queensland to locate the file when you inquire about progress on your complaint at a later date.

The police are the important people to report this too. As discussed with
the police bike squad reps at the BUG meeting a couple of months ago,
officers might attempt to discourage cyclists from making a complaint, but
press the issue and make them take one. You will need to attend the
station in person.

The police might say there's no point because it's just your word against
the driver's, etc, but that's not entirely true. As long as you managed to
get the vehicle details the police should contact the registered owner and
ask for an explanation. If the owner (or driver, if they direct the police
to somebody else) flat-out denies anything happened then there's probably
not much more that can be done (unless you have witnesses or other
evidence, of course), although if the officer has an appropriate attitude
then hopefully the driver will get a serious message about his/her
behaviour. However, the driver might well admit to some involvement (e.g.
something as silly as saying "that damned cyclist was in my way so I just
gave him a bit of a scare"), at which point the police will have something
to go on, and should be able to make something of it.

If the offender was in a commercial vehicle it can also be very worthwhile
to report the incident to the owner. Even if they don't particularly care
about cyclist safety most businesses don't like their drivers giving them
a bad name.

There also used to be a web site idiotdriver.com.au that was essentially a
database of (unverified) complaints against particular vehicles, so repeat
offenders could be identified. It went away a few years ago, but I thought
more recently I had seen a new site along similar lines - does anybody
know of it?

Thanks for the advice. As was stated, I have just reported this to the
City Police station on Charlotte St. The guy there was excellent, took
it all seriously, listened to my story, and told me that if I was
prepared to go to court, they could do something about it.

The process now is that they will contact the company whose truck it
is, find who was driving, and get their side of the story. He said
that based on that, they will issue him with a fine, if that's paid,
it's all good, otherwise it may go to court if he chooses to contest.

I am basically just after someone to tell this dickhead that driving
like that isn't appropriate, I don't really want to go to court, but
this happens often enough (even to me) that something needs to be done
about it.

Good on you for making a stand on that one. Perhaps not relevant, but I would like to relate my story.

I was clipped by a van's mirror about a month ago. No injury other than a slight bruise. And not a particularly unusual event for a regular cyclist. As usual, I didn't get the registration number and so nothing could be done. However for me it was the final straw after 15+ years of cycle commuting and just one more in a long list of near misses - I finally came to the conclusion that conditions on the roads are getting worse and not better for cyclists and that it is only a matter of time before my luck runs out and death or serious injury is a result. Has Campbell Newman's $100 Million done anything to encourage active transport? Not from my perspective! Far too little, far too late.

So, I no longer cycle to work. It pisses me off that I now just contribute to pollution and congestion and am getting fatter and lazier. But I am not ready to be a martyr to the cause.

Thanks for the stories. As it appears not a waste of time, I'm going to report my accident to the Police. A car decided to pull into a park along the curb just as he was passing me, knocking me and the bike onto the footpath. This occurred coming down the hill on Kedron Brook Road thru the Wilston shopping area on the way to work in the morning. Almost had a bad accident there a couple of years earlier with a pedestrian thru the same section so am now bypassing that stretch of road.

Was it a council garbo or a private one?

Call the relevant company/operator and report the time and location (and if you have it, rego/other details that may help them identify the issue)

You may also get some joy by reporting it the police if you have enough information.

               Depends on who in The Police you talk to? 
As I reported a driver not giving way to me on the crossing and The Police weren't really interested as they refuse to take the report, as they claim it is my word against the driver.

Campbell Newman 100 million has done fluck all for pedestrians and cyclists and now there is talk apart from The North-South Tunnel, The Northern Tunnel and The Hale St Bridge of a tunnel from Buranda to Toowong proving he doesn't love a Green Heart Brisbane.

I once tried reporting a guy who punched my car so hard and so many times that he left blood all over the window. The cops wrote a few details down and told me they weren't going to do anything about it. So, by all means report it but expect nothing!

I think you have to ring the Police at the time from the spot and report all details. You need the rego number and to secure nearby witnesses so the police can get statements.

I was in peak and passing on the inside and travelling in the bike lane beside a car for about 100 metres about a year ago and the driver decided to turn left with me beside the passenger door. He hit me and I had to lean into the vehicle, as he was stopping to turn, my right arm sheared off the left rear view mirror that was propelled down the road. He didn’t get a chance to actually turn and we hit parallel, he was very apologetic said he didn’t see me, offered to fix my bike, I was bleeding all over the place, he took me to a bike shop and dropped me at work. He got the quote from the bike shop and then said I was in the wrong. I have been pursued by his insurer ever since for the repair of the car.
