A person has his place of business in Kerala.He is a doctor by
profession.Never maintaned books till now.He wants to file his returns
in Karnataka. Can he file his returns in Karnataka?He is filing his
returns for first time.

Return is filed in the place where a person carries on business or
profession because jurisdiction of officers are decided by the area assigned
to them. It would perhaps not be possible to file a return in karnataka in
view of the fact that the tax officer may not have jurisdiction over the
place of business of the doctor. Moreover, maintenance of books is
mandatory to disclose correct income and more so because if a person
discloses income of Rs 1.2 lakhs (check the latest limit) or more it would
be obligatory for him to do so. Non maintenance of books may attract a
penalty and further be reason for best judgement assessment. Alternatively,
the deposits in bank accounts may also be considered as his income

yes peak credit in bank pass book might be considered as income. or excess of assets over liability might be considered as income..but it might attract penalty for non maintenace of books of accounts.
