As per the agreement builder needs to give posession within 24 months. If he fails to give posession, he needs to pay interest at the rate of 12%. You can call builder and ask for posession or interest. This way they will feel some presure.

I singed in dec so i cant call and ask for it. Those who have signed in oct, please call and ask for posession and/or interest @12%.

legally we cant as for that...
If u go through ur agreement, they must have clearly mentioned that, if the delay is because of things which are not in control of builder like government permissions or delay from supplier, they are not liable to pay the interest.
Please correct me if I'm wrong.

True, but:

1. I don't think it's any thing related with permission from government. I was told by Pravin(person in place of Bhavana) that your flats are ready but they are delaying the possession only because the road is not ready. If at this is the case they should not have given possession for A building.

2. Also, it's only because the builder is working at slow pace. If it's about govt permission's what are they doing since last 2 years. 

Most of us were given the possession date as Nov 2013(Diwali). Some how we need to make them realize that we can't take this delay anymore.

I spoke to Dhananjay yesterday. He says Dec 15 we will get keys for interior work. And end of Jan possession. Also, it his final promise (I doubt).

I visited site before Diwali. I just visited first floor still couple of flats are not completed, did not go upstair. Did not meet any one in office. Lot of work still looks pending but they are sticking to this dec and Jan date. 
My guess Mostly without amenities if they can give possession they will give as per there date. With complete amenities I don't see Jan 2015 is feasible date.

Hi All,

Today I visited Casa Imperia. Noticed few things.

1. Podium garden is now changed to plain garden.
2. The space where they had sales office they are constructing 3 story parking + club house.
3. Cleaning and final touch up  work was in progress. So hopefully we will get keys by Dec 15 and possession in Jan 2015.

Hi Guys,

I visited Casa Imperia today, and here is the update:

15th Dec is when they are planning to give the Keys for Furniture
End of January is the Possession of the flat as per them so far.

Well Interesting thing, Kids Garden will be ready at the time of Possession, but Club House and other amenities like Swimming Pool, they will only start Constructing it 3-4 months after possession. According to them Internal Road is part of the Amenities :)

Just a comment, so far we have seen for 1 year commitment from their side, it takes them 3 years, not sure by when we will actually get the amenities to use...but well thats what we have.

Here is an update.

I called Pravin, Casa Imperia.  He told me that they are starting keys handover process for furniture work.  There is balance payment to be made.  The OC is expected by end Jan.  He told me that two people have started furniture.  Please let me know if anyone in this group has taken keys.

I am planning to start few things from this month.

I got the keys. For everyone the process will start by Dec 15. You will need to make balance payment and pay additional amount for maintenance for next 12 month at the rate Rs.2 per sq feet (yes you read it right it is Rs.2). Pravin's justification is that unused amount will be transferred to Society once it is formed.


@ Jatin - If you are looking for finishing and hassle free experience go for Buy option. If you are looking for consistency in everything and have time and energy to invest go for Make option. Anyways you will need to get your modular kitchen made only.

I have also asked Dhananjay to ready my flat by 15 Dec. We have to pay balance outstanding amount before they can handover the keys. I also checked my flat and its almost ready some finishing work is pending which they said will be completed by 15 Dec. And yes handover of the keys is for furniture work only.

I asked for keys last week. I'll get it tomorrow. They take 8 days to handover keys for furniture even after making final payment. Pravin says we need 8 days for cleaning the flat.

Yes electricity, water not available. Even water taps fitting is not done. Probably they will do it at the time of actual possession. Dhananjay told me I can move in to apartment on Feb 1.

I talked earlier for letter, Dhananjay told we will be getting partial (not exactly partial but he used some word, I forget that), he says that is good for income tax purpose.

I took provisional possession letter and submitted to office for income tax. You can take provisional posession letter by paying your balance amount and maintenance payment for 1yr @ per sq.ft.

Hi all,

As we have been noticing builder is not adhering to his oral commitments, can we All ask him to give us in writing (provisinal oc or anything otherwise ) expected date of formal OC. As per them it will take another 6 months for PCMC water and related stuff,which can actualy take a year or more. Without OC it is illegal to occupy flats especially when we are paying entire flat cost ,getting OC is our right.

Besides we can hold meetings periodically with builder for pending issues to expedite OC and other things committed in agreement ..

It isn't easy for an individual to fight against builder.. We have to handle it as residents' body.

Please share your thoughts/ issues/ strategies around it.

I think its a good idea to have meeting as a group with the builder. I am ok with it.

Builder is highly unpredictable. As we have experienced the completion date has been frequently delayed. Now he wants us to take flat's possession without providing even the basic amenities. This is ridiculous. As being told drainage, water, gas etc are going to take time. It will be a big loss for us if take possession in this condition even for furniture as the flat cannot be used for anything. Even the guys making furniture need to stay there for few days which is not possible in the given condition.

We are the customers we are paying him for flat and not getting it for free. So he cannot force us to take the possession as and when he feels it. I am of the opinion that I would take the possession only when the flat is completely ready. Otherwise its no point to take the possession. Its like buying a car which cannot be driven because it has no wheels no steering and sorts.

Now almost all builders are missing their commitments.  Agree that we must jointly take it.  But some of us do not belong to Pune, so may not be possible.  But suggest to keep communicating with builders by mails even though they are not responding.  This may help us in building a case.  We even mark copy to all the group, so that they understand that we are fighting together and not individually.

I think let's we decide one date and time and all of us meet; note down the issues and possible monetary loss because of the issue and we can plan how to handle this. As our group is also small we can bring as many more we can do and probably more we group that can help us.
The big issue I can see on amenities side. Still final layout is not final forget about the timeline. 
As most of paying rent somewhere they definitely want move asap. I am one of them. 
Even I can see issues like OC, amenities don't see any other better way other than pay pending money as that is negligible in compare to what is already paid and get keys.

Yes, amanities point is perfectly valid and need followup.

Also do we have CA or good accountant in group?.. Because we will need his/her help for audititing building expenses done by builder. We can even discuss breakup of maintenance with builders.

I had talk with praveen today,he told me:
1. Lift ,water , electricity will start from 1 Feb

2.OC will be given by Jan end i.e. at Time of occupying.

3. Water pipeline is laid out just connection to main line is to pending and eta is 2 weeks post OC I.e. around 15 Feb.

Shout if you have any contradictory info.

I also have the same information. But issue is that they should stick to these dates.

You have raised a very good point to track expenses as builder is charging 2 per sq ft as maintenance. To sell his flats in upcoming C, D and E he will spend money carelessly to make everything look fabulous. You may notice A building is recently painted.

Also I have noticed that A building is still dependent on tankers. They still did not get pipeline connection I suppose, how come we will get it.

Other points adding to your list:
4. Piped gas connection will take anything between 4 to 6 months

5. There is only one internet provider JOISTER and builder has tie-up with him only as both owners know each other. No other cable internet is allowed.

6. There is fixed list of TV providers that builder has tie-up with. You can take only those connection. So forget about your existing connection. Also individual dish are not allowed.

7. Parking was supposed to be allotted by 15 Dec. No ETA on it.


Personally I would want the lift to be available by 24th Jan as then it gives us time to start moving stuff slowly.

We can plan to meet this weekend with the builder.

Hello All,

I am surprised to see the email saying people have to depend on tankers in A building.  This means the builder is not completing the things from his end.  When we booked the flat he had assured that would be 24 x 7 water supply. This itself shows how reliable the builder is. I think we must meet the builder collectively and raise all these questions. If possible catch hold of someone from A building so that the builder cant run away from the question.

Builder is charging 2 per sq foot because some he has to pay for water tanker in addition to many other things mentioned before.

Hi All,

Me & Yogesh spoke few mins back. Dhananjay confirmed Yogesh that there are nearly 16 people who are ready to occupy their flats on Feb 1, 2015. I see there are so many things pending.

1. Tap fittings & Water supply
2. Electricity
3. Lifts
4. Door bells
5. Security etc

If we are to occupy on Feb 1, we need to start pushing the builder now and we should get proper confirmation from him. I think we should ask from some hard copy/email confirmation, verbal confirmation does not help 

We will also have to ask builder to make all arrangements on or before 31 Jan and we should personally check on 31 Jan, so that we don't get last minute surprises. 

Let's meet this Saturday around 11 PM. We all can discuss between us and the speak to Dhananjay then. Please raise your points in this mail thread so that we can highlight to Dhananjay.

I wanted to add some inputs from my side-
1) Currently Electricity is available for each flat. I am sure because I have done pooja/vastukshanti of my own flat on end.of November '14 and I personally stay there on that night. It just need to start from distribution unit.
2) there are three water tanks on top floor /terrace for daily use, drinking and for solar system. I have personally climb and checked it.
3) I guess tap fitting is done in flat no B-1 1101. I heard it from site engineer.

I do agree about pushing builder for early completions. And we all need to ask him to give last demand on mail along with confirm possession date and amenities readiness.

Well I did visit the site today....I think C building construction is going in Full Swing, and according to me, the builder is not interested in giving the Amenities before the C building is ready...this is my take, as we know how well this builder has kept his past promises, he is saying in 6 Months all amenities will be done, I really doubt.

Weekdays, it is easy to tackle fewer audience for him, and hence Tuesday is the day for meeting.

We also need to check how safe the premises is for the Kids after 1st Feb, if he is giving possession at that time, and what measures they are going to take. We are just 2 weeks away, and I do not see any precautions taken yet.

Does anybody know anybody staying in Atlanta, the project in front of us along the main road. It is has been fully complete for some time now I guess though it started at the same time as casa. If residents there are getting water, gas etc. then we can hope to get them after some time as the builder is saying. If Atlanta residents are not getting these things and they are still getting water from tanker etc. then the whole area itself is problematic. In this case I dont think casa will get water etc even after six months , the builder is just trying to get us stay quiet. If somebody knows anybody staying around then please check and let us know. At least we will get some realistic idea.

To me to get things done from builder is two ways.
1. Surrender the builder,take false promises and get things when they ready.
2. Seek legal help and fight against builder. Ready to bear the cost and
Future consequences but chances are there you get your things on your condition.

5-6 family are staying there.
Drinking water is available for only 15
Minutes a day.
No TV as still management has not finalize dish operators for us.

This all I heard from residents, not experienced by my self.
