Some models, like googleNet and caffe reference network

are mentioned as having an unrestricted license on the repositories above.

On github gist however, they are covered by a non-commercial license

The BVLC GoogLeNet and CaffeNet models are unrestricted. Sergio (sguada) will remove the outdated gist, since the model is bundled with BVLC/caffe, to avoid confusion.

Model zoo models are under their own licenses. The uploader of the fine-tuned CaffeNet to Oxford flowers licensed it non-commercial, so that license should be respected.

But weren't GoogleNet and CaffeNet trained on ILSVRC data, which would force them to being non-commercial?

Please to the BVLC model license: http://caffe.berkeleyvision.org/model_zoo.html#bvlc-model-license (somehow this wasn't posted before as it should have been in the last release, but it's there now).
