The Recorded Webinars in Detail:

Session 1 — Lost Productivity Claims: Identification and Measurement

Dr. Ibbs dives into the starting point for lost productivity claims: identification and measurement. Learn different ways to measure productivity, how to use performance ratios, trending and forecasting. Loss of productivity is often the reason for other claim elements, such as delay, disruption, acceleration and extended overhead. Understanding the loss-of-productivity claim's strengths and weaknesses will help you evaluate other types of claims as well.

You will learn the latest technical and legal concepts associated with loss of productivity. Some of the issues that are covered include:
  • What is productivity?
  • How should it be measured?
  • What guidelines, methods, and tools are commonly used to measure loss of productivity?
  • When can loss-of-productivity claims be asserted?
  • What are recent developments in how courts and boards have treated loss-of-productivity claims?
  • What types of documentation should be assembled and developed in anticipation of a claim?
  • What contractual provisions can be used to present and support loss-of-productivity claims, and which can be used to rebut them?
  • And much, much more!

Session 2 — Pricing, Preparation, Support and Analysis of Lost Productivity Claims

William Schwartzkopf, author of Aspen Publishers’ Calculating Lost Labor Productivity in Construction Claims and Calculating Construction Damages, and his colleagues from Sage Consulting Group reviews what works in pricing, preparation, support, and analysis of lost productivity claims. The importance of a detailed analysis using actual cost records will be highlighted, and a variety of examples will be used to illustrate the calculation of damages by various methods such as actual cost, total cost, modified total cost, measured mile, and earned value. Learn which of the accepted methods of calculating lost labor productivity are appropriate in different situations, as well as how to calculate other types of costs, including extended field and home-office overhead, labor and equipment escalation costs, overtime, and acceleration costs. The expert speakers present time-tested tips on pricing, presenting, and defending against claims for loss of productivity.

As design/build, integrated project delivery (IPD) and other cooperative delivery methods gain favor, lean construction (and design) can be employed by the entire team - contractors, owners, A/Es, CMs and consultants.
