Here is a typical e-bike, the Samebike Pilot SE

Check out the clever answers in the FAQ excerpts below, noting the references to unlocking the 20 mph speed limit with which it’s delivered making it technically a legal Class 2. 

Most are like this. They’re delivered configured to be street legal as a Class 2 e-bike, so the manufacturer claims total innocence, but it’s trivial for the rider to reconfigure it in a way that makes it technically not a legal e-bike, thus requiring registration as a moped. 

Of course, when an owner makes the configuration change, it’s practically unenforceable. They have a beyond class e-bike that’s practically indistinguishable from a legal class 2. 

This one apparently only goes about 25 when unleashed, but others will go 30 or even 40+ in “off road” mode. 

I don’t know what the solution is. I don’t think there is one. Instead, I think we have to focus on conveying safe practices.

Do I have to register this bike?

Samebike bikes come to you with a max speed limit of 20mph, which means they are supervised as Class 2 bikes. That means you're not required to register it or get a license plate for it. But if you want to unlock the speed limit beyond 20MPH, you have to ask the local relative department if you need to register a license.

How fast does it go on gravel roads and how fast does it go on grass and dirt?

We have not practically tested the bike's top speed on different terrains. In addition, the bike has is 20" * 4.0" fat tires. And can adapt to every terrain. In the driving of the 1,000W motor, Its speed can reach beyond 25 MPH (after unlocking the speed limit).

The California DMV will not issue a moped license to an eBike that has no VIN as it is not certified as ‘road worthy’.
