Title Guarantee
A title guarantee policy provides 6 important types of protection that
have not previously been available in Romania:
· Title is vested in the borrower; a guarantee that the
borrower owns his property and that this cannot be challenged by third
parties. This includes protection against restitution, unexpected
inheritance claims and errors in Land Registry records;
Defects, liens, charges, incumbrances on the Title; a guarantee that
there are no other matters which affect the borrower's ownership of the
property that could impact the lender and reduce the value of the
lender's security;
Lack of a right of access to and from the borrower's property; a
guarantee that the property does not have problems with legal access;
Invalidity and unenforceability of a guaranteed mortgage against the
borrower. This includes protection for the bank that the borrower is
not acting fraudulently, forging documents or lacking the capacity to
understand the transaction that they are participating in.
Identity fraud in particular, perpetrated by individuals and organized
crime gangs, is now a common feature of mortgage markets throughout the
world and will become an issue in Romania as mortgage activity
accelerates;
Priority of other financial charges over the Guaranteed Mortgage. This
protection that there are no other financial charges with priority over
the mortgage that a bank is making;
The company will also pay the costs, legal fees and expenses in defence
of the Guaranteed Mortgage. This means that First Title has an
obligation to pay for a legal defence to defend the bank against any
claims covered by the guarantee, this includes other expenses, such as
appraisal costs if a property or title problem needs valuing.
Title Searches
Check of documents for problems of the title (assessing the property
title based on the documents submitted to us). (This implies no
specific investigation) Checking in the land registry: mortgages,
neighbors' or third party rights, rights of passage, renting more than
7 years, other liens.
Appraisal Services
An appraisal is a professional appraiser's opinion of value for a
property in Romania. As the preparation of an appraisal involves:
research into appropriate market areas, the assembly and analysis of
information pertinent to a property, the knowledge, experience and
