Dear Dr. Mishra,

This is in reference to recent communications from you and Mr. Mahendra Misra (dated 29 September 2015) regarding inviting nominations for BSNA President while the fact-finding activity is in the midst of the process. This action defies the constitutionally established rules and regulations, and BOT recommendations.

Please note that in order to address the reported controversy related to the irregularities in NEC process a BSNA Board of Trustees meeting was held on September 22, 2015. In that meeting it was decided by overwhelming majority vote to form a 3-member fact-finding subcommittee to look into allegations. Any subsequent actions are to be taken after the fact-finding committee has concluded its findings and submitted a report. This message was communicated to you with a copy to the BSNA Board of Trustees on September 23, 2015 (see attached a copy of the e-mail). The subcommittee has already begun its work.

Your current actions are not consistent with the Board’s decision to have a fact-finding task completed to address the controversy before taking any further steps.

You and/or any other committees appointed by EC are advised to follow the Board’s recommendations and wait for next action until the controversy is addressed using a constitutionally prescribed process, and the subcommittee has submitted its report. The task is anticipated to be completed within the next 2-3 weeks. Please also note that BSNA is a non-profit organization which is inexorable to follow its constitution and bylaws.
