Comprehensive information about BSNA President Election (2015-2018)

Dear BSNA Members,
In the last few weeks there has been inundation of e-mails related to the BSNA President’s Election for the term 2016-2018.
Dr. Shri Kant Mishra, outgoing President, has been calling everyone as ……. (Inappropriate words to reproduce here in e-mail) whosoever does not agree with his pre-determined expectation of the results of the BSNA elections, and he is not following the civilized rules and regulations. Dr. Shri Kant Mishra has been deliberately misleading the members by spreading statements such as “Dr. Keshav Shukla did not withdraw” (see attached e-mail to the contrary of this statement), distorted facts, trying to manipulate or acting in autocratic manner without any respect to BSNA Bylaws, Guidelines or procedures. Outgoing President, Dr. Shri Kant Mishra, is engaged in activities that have been significantly tarnishing the image of BSNA, having divisive effect on the organization and causing the operations of the Association to suffer. The nomination and election process and outcome is outlined here for your information as well as for the record.
Final Outcome of the Election Process
Mr. Bharat Mohla has been confirmed elected President of BSNA for the term 2016-2018 by Nomination and Election Committee on September 11, 2015, and that was ratified again by the full Board of Trustees by a majority vote on October 16, 2015.
Process
· A four member Nomination and Election Committee (NEC) was formed and announced by the BSNA President on April 14, 2015. Per BSNA Constitution ARTICLE XII: COMMITTEES, Section 1: Nomination and Election Committee. iv, the NEC should consist of three members only. Mr. Purushottam Sharma chaired the committee with Dr. Shiva Bajpai, Dr. Sen Pathak and Dr. Akkaraju Sarma as members. Per NEC Guidelines this committee should function independently without any interference from the President and/or Executive Committee to conduct fair and unbiased elections. However, this rule was often violated by Dr. Shri Kant Mishra during the process. Excerpt from NEC e-mail appeared in the fact-finding committee’s report - “Dr. Shri Kant Mishra tried to dictate to NEC his views”, “He tried to twist the facts and manipulated the NEC”, etc. (e-mail 23 Sep2015, P. · Two nominated candidates (Dr. Keshav Shukla and Mr. Bharat Mohla) were confirmed as qualified candidates by the Nomination and Election Committee – e-mails, August 23-27, 2015, and Sept 7-8, 2015.
· Even though some of the NEC members were in favor of fair elections, outgoing President, Dr. Shri Kant Mishra, tried to mediate a compromise between both candidates which did not work-out. e-mail (Sept 11, 2015; K. Shukla)
· On September 11, 2015 (10:35 a.m. EST) one of the candidates, Dr. Keshav Shukla, withdrew his nomination – e-mail (Sept 11, 2015; K.Shukla – see attached)
· Only candidate left in the race, Mr. Bharat Mohla, was declared as elected BSNA President on September 11, 2015 (9:22 p.m. EST) for the term 2016-2018 per the Nomination and Election Committee Guidelines, and BSNA precedence. E-mail Sept 11, 2015 at 9:22 p.m. EST; P. Sharma.
· Subsequently, a number of e-mail communications erupted complaining about the irregularities in the election process. Both candidates (Sept 17 and 18, 2015; K Shukla, Sept 16, 2015; B Mohla) and NEC Chair formally requested Board of Trustees (BOT) to look into allegations. Additionally, a lot of e-mail allegations from Dr. Shri Kant Mishra in flowery language. Many e-mails from Dr. Shri Kant Mishra starting Sept 13, 2015.
· A full Board of Trustees (all 13 members) met via a teleconference on September 22, 2015 to find amicable solution to the problem and preserve the sanctity of the organization. After a thoughtful and thorough discussion, and consistent with the BSNA Constitution ARTICLE X: THE BOARD OF TRUSTEES, Section 2.vi and Section 2.vii, BOT decided to form a 3-member fact-finding subcommittee by a majority vote to investigate (fact-finding) the allegations, prepare a report and make a recommendation to the full Board. BOT also approved well respected Board members known for their integrity, Hon. Shri Upendra Chivukula as Chair of the Committee with Prof. Dr. Ramesh Pandey and Dr. Lok Shandilya as members. Please note that these are highly respected and greatly accomplished outstanding members of the society and their respective professions.
· The subcommittee conducted an evidence based thorough investigations (fact-finding), prepared a detailed report that was sent to the BOT members in advance of the meeting, and presented the recommendations to the full BOT (12 out of 13 members in attendance) on October 16, 2015 in a teleconference. The independent fact-finding committee found that i) the election process was conducted appropriately, and ii) after the withdrawal of one of the two candidates, the only remaining candidate Mr. Bharat Mohla should be declared BSNA President for the term 2016-2018. Pursuant to the due process the full BOT decided to approve the recommendations of the subcommittee by a majority vote. As a result BOT approved (reaffirmed) that i) the NEC conducted the BSNA President Elections 2016-2018 appropriately according to the NEC Guidelines, and ii) therefore the declaration of Mr. Bharat Mohla as President was found valid. Per BSNA Constitution ARTICLE X: THE BOARD OF TRUSTEES, Section 2.vi and Section 2.vii, this final decision of the BSNA Board of Trustees shall be binding on all parties within BSNA.
I had communicated these findings to you via e-mail on October 16, 2015.
On behalf of BSNA members I would like to express our gratitude to the BOT members, the fact-finding Subcommittee members, and NEC members to actively participate in this activity and provide their self-less services to the organization and hence to the community.
Also, I take this opportunity to thank Dr. Shri Kant Mishra and his Executive Committee for serving the organization during the term 2012-2015 that is going to expire within a couple of months. I hope they will extend their full support to the incoming team and cooperate to strengthen the BSNA.
With this e-mail I would like to stop further communications on this topic and suggest the President Elect, Mr. Bharat Mohla, to start preparing to serve the BSNA with his team for the next term (2016-2018).
