BSNA Board of Trustees Upheld the Election of Mr. Bharat Mohla as BSNA President for 2016-2018

To - Candidates/BSNA President/NEC Chair,

In order to address the complaints and allegations regarding BSNA-2016-2018 election process, BSNA Board of Trustees formed a 3-member independent fact-finding subcommittee on September 22, 2015 as per Article X, Section 2.vi. The subcommittee constituted of the following 3 distinguished BOT members:

1.    Hon. Shri Upendra Chivukula - Chair

2.    Prof. Dr. Ramesh Pandey, Ph.D. - Member

3.    Dr. Lok Shandilya, M.D., Ph.D. - Member

After a thorough and complete investigation of the issues, this subcommittee presented its recommendations to the full Board of Trustees on October 16, 2015 in a teleconference call. Subsequently the BSNA Board of Trustees has approved these recommendations by a majority vote (8 yes, 4 no). A copy of the report is attached for your reference.

BSNA BOT- approved recommendations of the subcommittee as discussed during the teleconference on October 16, 2015:

Based on the review of the information, it is the opinion of the subcommittee that the election process was conducted properly. After the withdrawal of one of the two candidates, the only remaining candidate Mr. Bharat Mohla should be declared BSNA President for the term 2016-2018.

NEC Chair reached that conclusion appropriately as there was only one candidate left.  NEC Chair did conduct the election process properly and did not violate any NEC or BSNA rules. It was in his right to declare only candidate remaining as the next President.

BoT has several learnings from these on-going and continuing issues raised during the current and previous elections, a by-laws subcommittee should be formed to review and develop better guidelines to avoid future issues that are potentially divisive.

Per BSNA Constitution, Article X. Section 2.vi and Section 2.vii this decision of the BSNA BOT is a binding on all parties within BSNA (see below)

 

In conclusion this is the BSNA Board of Trustees’ decision (8- yes/4-no) that i) the election process for BSNA President was conducted appropriately according to the NEC guidelines, and ii) the Board of Trustees ratifies the declaration of Mr. Bharat Mohla as BSNA President for the term 2016-2018.
