Good afternoon all,

I believe we discussed tariffs previously, and I wanted to revisit the topic. Since tariffs are government-imposed and not initiated by the vendor, we certainly do not want to unfairly penalize the contractor.

That said, we have reviewed the contract and have not found any language that would support payment of tariff-related costs. The agreement does specify that the contractor is responsible for taxes, permits, patent fees, royalties, and similar expenses.

Have any of you encountered situations where tariffs impacted a contract? If so, how was it handled? I would appreciate any insight or guidance you can share.

Thank you,

Kelly Gutierrez, NIGP-PPA, FCCM
