Subject: 35 Day Deadline on Construction Change Orders - Effective July 1

Effective July 1, 2025, a new section 218.755, Florida Statutes, requires local governments to approve or deny contractor-submitted change order quotes within 35 days. If no response is given, the quote is deemed automatically approved and payment is required upon completion. This deadline cannot be waived by contract.
This presents a real challenge when the change order exceeds delegated authority or the approved budget, especially for entities whose boards meet bi-weekly or monthly. It leaves limited time for technical review, internal approvals, and formal contract execution.
We’re brainstorming and exploring options, but none are ideal, some of these options include (1) formalizing approval followed by seeking the Board’s ratification, (2) requesting increased delegated authority (unlimited for change orders) for either the CPO or Department Directors, or (3) developing a Board Appointed oversight committee with unlimited Change Order Authority to meet on a more frequent basis.
How are others planning to manage this timeline? What strategies are you exploring? I am eager to hear from you.
