Hi all,

Thanks for your time. Here are the notes from our meeting:
  • Attendees: Kathleen, Rosemarie, Eddie, Rachel, Danielle, Robin
  • Review of the incident:
    • Robin got a message from Joy
    • Gil has been taking a broom and banging on the ceiling and telling her that from 1am – 4am her daughter is walking with heels on
    • He has also been talking to her in the hallway saying that he’s going to report her to the town for the wall she put up and sue her
      • She was very concerned about this and CPA advised her to not get an engineer in to review the wall (Board agreed)
    • Robin talked to Gil and he corroborated what Joy said
  • Kathleen put together a draft of a letter to present to Gil that he has to sign acknowledging that if this conduct happens again, he could be terminated. This group should review the document and suggest edits. Goal to have this finalized by Friday.
  • Suggestions from meeting:
    • Add: We don’t understand this behavior because this is not indicative of who we think you are
    • Add: Confidential and should not be discussed with others – will result in consequences for that
  • This letter has to come from the board and include all of our signatures
  • Risk that he could refuse to leave the apartment if he is terminated
  • Options for coverage:
    • Short period of time – Davis
    • Have some names of people (3 people)
      • May put out feelers to them
  • Robin will communicate resolution with Joy
  • Gil is going to be called in for a meeting on Monday 3/30 at 7pm
    • Board members and CPA will be there too
  • If he refuses to come to the meeting on Monday, we will serve him letter of termination
    • Is there a legal amount of time to let him leave? Robin to talk to an attorney

After I got home last night, I was thinking and there may be something else going on that I didn't put together until last night. When i Spoke to Joy she said that she sometimes is disturbed by noise from above her from Francesca. Joy says it sounds like some kind of machine and it is always between 1am-4am. Knowing that Francesca is always messing with the plumbing also, It is possible that the noises Gil is hearing could have something to do with that. 

Francesca did put out garbage Tuesday night so we'll see if she lets us in for an inspection and find something going on in there. We gave her until tomorrow to get back in touch with us. 

It doesn't change that Gil was out of line at all or change the letter or anything else, but just had to share this with you.

I updated the letter with his name but the letter looks great. 

NYS housing law states that a tenant has to be given 90 days notice to vacate the unit. In this situation Gil is considered a tenant. If he was not to vacate at the end of the 90 days then an eviction proceeding would be commenced. An attorney handles the 90 day notice to terminate tenancy and subsequently the eviction at the expiration of that 90 day period.

That's interesting, Robin. I'm not sure if what Francesca is doing would sound like walking in Gil's apartment, but anything is possible. As you noted, either way, it doesn't change how we're moving forward.

Also, something I thought of, we should have at least a couple copies that we all sign on Monday. At minimum, one for Gil to keep and one for our records.

Last night early morning Francesca left her apartment at 4:28am with 2 bags of garbage. Then she brought up the white cart. She didn’t leave after that.

Should we remove the titles of the paragraphs and if it's all good we should add our names and everything on the bottom my opinion
