Finally got last piece of information

Finally the state has mailed me a copy of my 2010 tax returns which is
the only thing I was waiting for. All that is left to do is fax the
information to my attorney and wait for the 341 meeting. My bankrupcy
is pretty simple so I'm not expecting any glitches *crosses fingers*

I also received this weekend from the attorney office that Capital One
is using to sue me a separate summons from them that says they are
suing me for attorney fees to collect the debt. Pretty lucrative
business since it is to the tune of 2k for an 8k debt. My attorney
has already begun the process of filing so I am wondering if this will
be an additional creditor? Will I have to pay additional fees to the
attorney to add this to my C-13? Will I continue to receive this
going forward and do I have to add them each time? I got this in the
mail after I met with my attorney so I didn't know about it before we
met. I am hoping that they don't charge a fee to add it. :( Thoughts
for those of you that have gone through it already?

Hi Mountando - I believe AT WORST it's $26 to add a creditor. BUT if
this law office is NOT a creditor - that is - if Cap One has NOT sold
them the debt, then they just need your filing notice...either way, no
worries - they can't do anything!!! Let your lawyer know!!!

Always let them know when these outfits pop up - but as long as Cap
One is included as a creditor, you're fine!!!

What do you mean? Cause a couple of my judgements went through law
offices, oh no. Can I still include them? OMG I am swrewed...I think
they own the debts there is no way I can do this if so.

Karm, don't panic. The fact that the judgments went through law
offices mean that the creditors were represented by legal counsel. I
am not able to refer to your earlier posts for some *strange* reason,
so am flying blind here. Include these law firms and the judgments.
Also include the original creditor(s)--everything you can think of--in
your paperwork. Better to have redundancies and not need them.

I hope Despritfreya, Justbroke, or a couple of the others will chime
in.

really, most of the time you are fine as long as you named the
original creditor. actually, many times one doesn't even know when
their account has been shipped out to a collection agency or a law
firm. all you have to do, if they come back at you, is give them your
docket number and you should be fine.

as IamOld stated, if you left someone off your petition it's a simply
filing fee to get them listed. also if you already have judgements,
after you are discharged you will have to file a separate motion to
vacate those judgments. actually you must do that or they will stick
around. it's a simple process you can do it yourself with the court
after you are discharged and closed.

when you filled out your petition, if you already had judgments you
must have listed them. there is a place on the petition do list any
outstanding judgments at the time of your filing. if you didn't list
them on your petition you really are best off amending the petition to
include the docket numbers of those judgments so you can move to
vacate them when you are discharged and closed.

Last year, right after I filed I had to add a creditor, which cost me
an additional $250 to my attorney. The creditor was a merchant that
claimed I owed them $1,000. I felt that it was worth the extra money
to ammend them. I also think that how much it will cost, varies by
district.

Then too, in my area, I guess the "new" petition has to be mailed out
again to all the creditors. With the amount of creditors and their
representatives I had, the postage probably was close to $100
alone. :-)

Well, this notice is just saying the attorney office is suing me for
their attorney fees. My attorney already has the name of the original
creditor and the summons that this attorney sent in regards to that.
I will fax the additional info to my attorney tomorrow. I am assuming
that they are just throwing their claim into the pot. It's possible
that they have already been notified that I am filing C-13.

I didnt file yet, still in the preperation stage. Cannot file until
Jan31, What about house appraisals, any info how to get a descent one
meaning do not want them to over appraise what it is worth I may have
about 20 thousand in equity. Not sure but I do not think it went up or
down. Took me 2 years to finally decide to file,seen a attorney 2
years ago and he said I would need a appraisal. I am gonna most likely
use him because he has over 30 year experience. At that time i made
way too much, Anyway he didnt ask me a million questions about my
bills but he is highly reccomended by alot of sights. Not sure if its
a good thing that he didnt ask alot of questions.but he told me to
lower my wage and come back in 6 months. He was gonna include his
payment which I need him to, so another reason im broke cause im
paying a couple judgements, do not have any money to save... sorry im
rambling.....

karma, perhaps you can ask your atty for a suggestion as to who to get
an appraisal from...usually listing agents will give you one for free,
but I'd as the atty.

Also, jus tmake sure that you include anything and everyone on your
filing!

i'm not a "13" person, and hope Flamingo or Iprin can answer your
questions better.

i am going to say, from what i have read in the past, that since your
atty did, in fact, list that original creditor, it should be covered.
