If I intend to sell a particular photo as 'art', as opposed to "commercial use", do I need a property release for any identifiable property in the photo ?
Is a gallery, or private sale, as 'art' considered differently than 'editorial' or 'commercial' use of a stock photo.
Also, if the identifiable item in the photo is modified in Photoshop, to eliminate the identifiable characteristic of the property, i.e. a trademarked name on an item, does this negate the need for a release (if one was required in the first place) ?
