What, if any, policies are at your institution related to the number of hours per week a student employee can work?  Are exceptions allowed and, if so, who has the authority for granting exceptions?

Kansas State University Reply:

30 hours per week when classes are in session; 40 hours per week in summer when not enrolled and during fall, winter, spring breaks. No exceptions for the 30 hours limit. Here is the policy:

We did not make any changes in this policy as a result of the Affordable Care Act.

Oklahoma State University

For a typical student, there are no restrictions placed on the amount of hours that the individual can work unless there is a restriction due to the immigration status of the individual.

For a student who is employed as a GTA/GRA, he/ she is limited to no more than 30 hours per week (0.75 FTE) during the summer and 20 hours per week (0.50 FTE) during the regular academic year. Exceptions to these limitations are handled by the Dean of the Graduate College.

Student Employee Information
General Information

Definition:
Employment of a student of Iowa State University who was hired as a work study or non-work study employee.

Authority:
Students working as part-time public employees twenty hours per week or less, except graduate or other postgraduate students in preparation for a profession who are engaged in academically related employment as a teaching, research or service assistant. Iowa Code - 20.4 (4) Public Employment Relations - Exclusion

All presidents, deans, directors, teachers, professional and scientific personnel and student employees are under the jurisdiction of the state Board of Regents. Iowa Code - 8A.412 (5) Merit System - Applicabaility - Exceptions

Expectations for Student Employees
• Do not replace merit or P&S staff
• Are registered as Iowa State students for at least one credit hour in the semester of employment
• Can continue as a student employee though the end of month of graduation, as long as otherwise authorized and permitted, i.e. international students cannot work beyond the end of the semester in which they graduate unless they are registered as a student for the following fall semester
• Can be considered student employees, during summer, if registered for the next fall semester
• Are limited to 20 hours or less per week when classes are in session, except during summer session
• Will be paid for hours worked. Hours worked over 40 in a work week will be paid at time and one-half. Hours will be tracked by standard wage hour reports and be paid through XH pay base


Student FICA Information
• Wages earned by undergraduate students who are enrolled at Iowa State University and are at least half-time students are exempt from FICA and Medicare taxes. Students attain half-time status by enrolling in at least 6 credit hours during the fall and spring semesters and 3 credit hours during the summer session. Graduate students must be registered for 5 credit hours or more during the fall and spring semesters and 3 credit hours or more during the summer session to be exempt from FICA and Medicare taxes.
• Wages earned during the summer months by students not registered in summer classes are subject to FICA and Medicare withholding.

University of Kansas:

The University of Kansas has implemented policy (http://policy.ku.edu/human-resources/student-employee-eligibility-aca) that restricts student hourly appointments to the equivalent of a 50% full-time equivalency appointment (20 hours per week) during the academic year, when classes are in session.  Graduate student appointments may not exceed the equivalent of a 72.5% full-time equivalence appointment (29 hours per week).  Weekly hourly limits apply to total hours worked on all combined campus student appointments. 

 

The policy became effective on July 24, 2014, and to provide deans and vice provosts some flexibility in first year, academic departments were given the discretion to employ undergraduate student employees up to 29 hours a week in non-work study funded student positions during the academic year when classes are in session and up to 40 hours a week during breaks and over the summer.  If such employment makes the undergraduate student employee ACA-eligible, the department will assume the potential fiscal liability.
