Good afternoon everyone-Congressman Bobby Scott recently introduced the Paystub Transparency Act, which would require all employees to get paystubs with full information about their classification, hours worked, how they're paid, and what's deducted from their pay. I don't need to tell all of you what an important tool this would be in the fight against wage theft, but below is the Dear Colleague Letter that Congressman Scott's sent out to his colleagues asking for their co-sponsorship.

We've also put together a sign on letter that we'd love for your organization to be part of.

REQUEST TO COSPONSOR THE "PAY STUB DISCLOSURE ACT," H.R. 4376, WHICH PROVIDES WORKERS WITH THE RIGHT TO A PAY STUB SHOWING HOW THEIR WAGES ARE CALCULATED

Dear Colleague:

A raise is long overdue for America's hardworking families. That's why Democrats support raising the minimum wage and making more workers eligible for overtime pay. But these steps alone are not enough. To ensure that these reforms actually boost family incomes, workers need to have the tools to recognize when they have been cheated out of their pay. That is where current law falls short.

Today, there is no guarantee in federal law that with each paycheck, workers will get a pay stub showing how their wages are calculated. And employees have no remedy when their employers fail to keep records of their pay, as employers are required to do under the Fair Labor Standards Act.

Too many employers exploit these gaps in the law to commit wage theft. In 2012, victims of wage theft recovered $933 million in stolen wages through complaints filed with federal, state, or local agencies or through private litigation, according to the Economic Policy Institute. But this staggering figure represents only a fraction of the total amount of stolen wages every year, which is estimated to be as much as $50 billion nationally.

Workers need better tools to fight back against wage theft. That is why earlier this month I introduced H.R. 4376, the Pay Stub Disclosure Act.

The Pay Stub Disclosure Act will:

* Require employers to provide pay stubs to employees who are not exempt from the Fair Labor Standards Act's minimum wage and overtime requirements, explaining how their wages are calculated, including whether they were paid overtime;

* Give employees the right to inspect their own payroll records;

* Provide a private right of action and financial remedy to employees whose rights to a pay stub or records inspection are violated; and

* Codify the legal presumption that if an employer fails to keep records of an employee's pay, the employee's own credible evidence and testimony about his or her pay is presumed to be true.
Each week, millions of American workers are cheated out of their wages, leading to millions of dollars in lost income. A study commissioned by the Department of Labor in 2014 estimated that there were over 600,000 weekly minimum wage violations in California and New York, representing 3.5 and 6.5 percent of covered, non-exempt jobs in those states respectively. These violations added up to $28.7 million in weekly lost income for California's workers and $20.1 million in weekly lost income for New York's workers.
