Dear Malancha friends,

I am a newly joined member of this group. I have also recenly received
a letter from Bengal DCL regarding the price escalation, service tax
etc. I echo the same sentimnets as you had discussed earlier and am
willing to support your views. We should form a collective opinion and
should strongly oppose the recent price escalation. In my opinion, we
should proceed to consumer court collectively at our earliest. Please
keep me updated about your views. Looking forward to your reply.

This is good that you have resolved to go ahead with this issue. I congratulate you and will do whatever I can to help. I am doing the same at a personal. It would be good to know your plan. Can you share your thoughts? If you want to keep that private that's OK. 

Be advised that BDCL's letter asking for more money is well crafted. If you review the terms & conditions (which like myself, you all agreed to), BDCL left it open to charge extra for abnormal hike in the cost of steel and cement. These two inputs comprise more than 20% of the project cost.

They are also in line with the agreed upon method for calculating the prices hike. This is based on RBI wholesale price index.

Another component of the price hike is the so called service tax. Now I have no idea when this came about and what kind of things come under the purview of this tax. Those of you who currently live in India will be in a better position to educate the rest of us.

The terms and conditions also give BDCL a long rope to alter plans and materials as they seem fit. There is not a long list of architectural specifications that we were provided and was made part of the contract. My understanding is that the job done thus far is not of high quality. Those who have been there recently can confirm this. So who knows what we end up getting after this all is over.

The RBI wholesale price index used by BDCL to calculate the extra money is loosy-goosey. RBI web site does not provide any specific PI for steel and cement. BDCL's letter does not provide level of details that would support their claim. So this is an area where one can spend some time and build a case.

Does anybody in the group have the information about demand and supply of steel and cement between Feb '07 and Mar '10?

Hi - I have been reading this group on and off for some time. Five to six months back I proposed to compile our list of owners and also suggested to run our issues by a lawyer just too see what can we do legally? Can anybody take a lead, specifially, who is in Kolkata or nearby? 
 
Just a thought: Does anybody know any other builder who started around the same time DCL started building Malancha but already finished their project?  Can this be a point in our favour?

Unfortunately there is no builder who started at the same time BDCL started and already handed over the project..
DLF launched 6 months later, they will handover after 1.5 year..
other ...better not to mention..
Shapoorji Pallonji launched their mass housing project (MIG & LIG) 6 months later with a promise to handover in January 2009...Huh! they have promised to handover in January 2011 (actually not.. they will again promise some future date..)
Builders are to some extent consistent in their execution...
I still find BDCL scores more marks than others in terms of work completion...(forget quality)
Elite Garden Vista (from Keppal Megas, Singapore) however, has beaten BDCL, they launched later but I heard they already handed over phase-1 (somebody may verify the truth, I am not sure)...
Mr. Caeser Dutta ( Hi Ceaser, how are you ?) may share some more info...

Let us strengthen initiative of Mr Puspayan and if nothing comes out
then we can move to legal recourse when we find delivered flat did not
meet promised quality and timeframe .Remember Anna/Ramdev baba style
satyagraha is bringing result nowadays. notwithstanding the fact that
other builders are faltering , we should keep the pressure on so that
delivery remains within 2011.

Did DCL commit any timeline recently for delivering of HIG flat? I knew, DCL sent the letter for MIG/LIG handover. But, I did not receive any formal comms for HIG handover. I found few of us referred to August timeline.

mentioned.according my study only lig handing over letter is
issued.mig handing over letter is not issued.cement hike letter is
issued with soft handing over mention is issued.if any member from lig
or mig is reading this mail pleease update in this forum.delay affects
everybody and all our initiatives should be unified

I looked at the HIG letter and this is what is written:
 
"Please note that all work inside the cluster within the scope of DCL will be completed by July 2011 and DCL will be in a position to handover the Mallika apartments   from August 2011 . "
 
It does talk about no permanent power and hence lift cannot operate etc etc in subsequent lines though . So they did communicate August ; but with caveats :-(

The latest news heard from BDCL is:
 
  • Electricity connection in 3-4mths. (21st May under-ground cabling work started)
  • LIG posession given (to be confirmed by our people there)
  • MIG completed but without electricity and lift mechanism unchecked. Hence delay of another 3-4mths in the hope of electricity.
  • HIG posession expected now in September 2011 (note: already dealine is shifting)
  • HIG externally looks almost the same as seen in 2010!! (need more pictures to confirm further).
  • HIG internally floorings done ( all - ? ) and now work is being done for tiling, bathroom and kitchen fittings (from topmost floor to downwards). Upto what percentage of work has been done in all 3 TOWERS - This no one knows?
  • HIG lifts have been installed. (confirmation needed)
  • Tower 4 progressed till 4 stoerys.

Perhaps it is time to move up things a little more urgently NOW. For people like us who live outside kolkata our physical absence becomes a difficult matter to step up pressure on BDCL.....also many flat-owners being NRIs this is something that is blatantly being taken advantage of by BDCL. They languish in the idea that most of us have bought apartments for just investment purpose and therefore calmly predict that before 2013 the area wont be inhabited.
 
However Im sure there are many like us who really want the apartments to be ready by the last given deadline of Sept' 2011 atleast - so that other infrastructural developments like - water, electricity, shops, transpotation could be concentrated one. WE WANT TO LIVE THERE...as soon as possible. I hope atleast 50% flat-owners would agree on that.
 
Our silence and singular personal visits are all falling on deaf ears it seems...not to mention the price escalation issue. Could we all be more active through the net atleast...Facebook & Google and show some solidarity in our collective grievance. Please visit the site ...upload images/ videaos you have taken on the Malancha groups. The more people are taking up the cause ... it would enable us to be aware of actual facts as against twisted truths from BDCL. The more questions asked ... the more pressurised BDCL would be in answering our collective demands. 
 
This has now become an issue of paramount importance if we really wish to have HIG posessions given in 2011. All members of LIG, MIG & HIG need to give in their feedback as MALANCHA cluster unites all of us......if not in fraternity then in desperation atleast!!

In reference to Mr Caeser Dutta's input (highly appreceable effort) one point is proved and that is that there is a huge huge gap between reality and what BDCL is suggesting, informing or predicting. If at this juncture we do not show our solidarity by vehemently supporting people who are personally going there to Malancha site and BDCL office - thereby representing not only their personal but also our collective woes and concerns, then it would be a grave mistake.
 
BDCL might try to finish work in lightening speed in the last few months before posession but we would all be wondering at what cost? Poor quality of work is one big penalty that we might have to pay and live with since most of it will only show 1-2yrs after posession. We might repent endlessly later on but by then it would be useless.
 
Instead, let us all become very very aware and cautious of every step, every development that BDCL is undertaking and keep a tight watch on quality as much as adherence/ faltering of deadline. I am very pleased to see all of us taking such positive steps in ensuring this. I promise to do my part during our October visit to Kolkata this year.

Friends (and future neighbors) ,

Appreciate the reports and feedbacks provided so far by folks who are in communication with BDCL (I mean lies, lies, and damn lies from BDCL) and routinely visiting the site.

Here are some information that I have come across:

The electrical substation should either be ready or under construction. There is currently a 10 KW temporary electricity supply to support the construction work. Laying out of underground electricity cables for permanent electricity should be at the early stage.

As well, the MIG / LIG buildings should be getting water from the deep tube well already installed (i.e. water is being pumped from the deep tube well reservoir). The rain harvesting system should be under construction. Work on the inside of HIG building should be underway.

There is no way to tell how accurate these information are. From earlier reports / feedbacks provided by Gautam Sarkar and Caeser Dutta, it seems nothing substantive is going on. Could I ask those visiting the site to verify these or look out for these? While you are there, please check with the BDCL construction engineering office as well and see if you can gather anything of value.

Has anybody written up a rebuttal / refusal to pay the extra (I mean extortion) money to BDCL? If so, what are the repercussions from BDCL, if any? I am still researching for data on price escalation. Any help will be greatly appreciated.

Srinibas Tripathy, your help is needed. Your research work early-on was very helpful. You have gone silent.
