Distracted
Driving
Decision

Law
enforcement
officials
don't have to
prove why a
driver was
distracted,
only that the
driver was
in fact
distracted,
according to a
decision
delivered
recently by
the Maine
Supreme
Judicial
Court.
The
ruling is
important,
Lauri
Boxer-Macomber,
a member of
the Bicycle
Coalition of
Maine Board of
Directors and
attorney who
filed a
friend-of-the-court
brief on
behalf of the
Coalition, told the Portland Press
Herald,
because, "you
do not
necessarily
have to catch
someone in the
process of
sending or
reading a
text, or
eating a
hamburger, or
any other
thing. You can
use
circumstantial
evidence to
prove
distracted
driving."
The
decision was
issued in
connection
with a fatal
crash that
occurred in
August 2015 in
Woolwich.
Thomas Palmer
was convicted
of distracted
driving after
he struck a
car that was
waiting to
make a turn on
US Route 1.
According to
court
documents,
Thomas never
braked before
his truck
smashed into
the car, which
was forced
into a van,
which in turn
struck an SUV.
A passenger in
the van died.

walking, and
is the result
of extensive
work by
Ogunquit's
Bike/Ped
Committee,
which includes
Bicycle
Coalition of
Maine
co-founder
Charley
LaFlamme among
its members.
The
People's
Choice Award
winner will be
decided by
online voting.
