I am really glad to recieve your reply of clarification. But believe me, I really did not try to hurt your feelings. You know very well that I tried to assist your committee at the extent of my ability and I swear that I will be happy to assist the new committee and the new President of BCS. 
 
I believe that you know that I have nothing wrong personally against you. I rather respect you as a gutsy & dynamic person. I have nothing to say about the person who has been announced as the new President, rather I must appreciate that he has come forward to shoulder the responsibilty at a very difficult point of time.
 
 I just can not appreciate the way he was announced to be the next President. I am trying to explain again where the procedure was constitutionally wrong. There is a constitution of BCS and as a member I respect it. 
 
Mr Dutta, most humbly I like to inform you that I have gone through the entire BCS constitution before criticising you and I think that as a member of BCS I have enough right to focus where it went wrong especially as I was present in the last AGM.
 
The terminal AGM of 2008 BCS committee was postponed and rescheduled at least thrice before it ultimately commenced on 16.02.2009. I was among the few 26 members who attended the meeting (as per your mail dated 18/2/09 ).


According to the clauses of constitution- The New president should be selected or elected in the AGM.
 
1) THE CLAUSE NO: 17.1.1 says that AGM shall be held at the expiry of the term and by not later than 15th January of the following year. The AGM commenced on 16th February 2009.
 
2) THE CLAUSE NO: 18.1(A)- clearly reveals that The Notice of the AGM should be given "not less than 14 days prior to it's commencement". Can you please remember when was it announced? Most of the honourable member's of BCS were not aware of the date. Moreover most of them could not attend because it commenced on a working day. I am very fortunate to be among the few persons who attended the meeting
 
3) THE CLAUSE NO: 17.4 says that a QUORUM is mandatory in AGM. The Quorum is the presence of at least 25% of the Members present in Kuwait.  The AGM was conducted with the presence of only 26 members out of about 200 existing members ( of course I am not absolutely sure that  out of 200 members at least 100 members were out of Kuwait at that time). " A 10 minutes break was given to find out the next president among the 26 members including 10 members of the executive committee who were present in the AGM".Is not it sounding ridiculous !!!  What is the significance of the AGM without Qourum and what is the significance of it's MOM?
 
4) There is no mention in the Constitution that if no President comes out in the AGM, then any Proposal in the official nomination form reaching the Ex President will be announced as "BREAKING NEWS" in the electronic media and will be accepted and published in the media as crucial by the Ex President.
 
It would certainly have been better for you - if you would have send the news in GROUP MAIL that a responsible and honoured member has accepted to shoulder the responsiblity and later on you would have arranged an  AGM to give us opportunity to introduce the members with the New President and the New Committee and to express opinion of the honoured members of BCS.
 
Mr Dutta , my membership stands just 2 years old. As a new member I was surprised and shocked when I can percept that something is written in the Constitution and something else is done.
 
Please let this mail be published in the group to let me know from the honoured members as well as  from you where I was wrong. Hoping you in good shape and health and again conveying my gratitude to you for successfully conveying all the programmes of BCS 2008.

I have read your mail with great care and wish to humbly but firmly set the record straight in the following:

 

1.          There was no violation of BCS’ constitutional procedure as far as appointment of the President was concerned as in the AGM our vice-president Mr. Pinaki Sanyal very duly invited anybody from the members present in the meeting to take over as the new President but, unfortunately, nobody did so. This was recorded in the last item of the M.O.M. (Minutes of Meeting) prepared in that AGM which is reproduced below for your quick reference.

           6.     Pinaki Ranjan Sanyal (PRS) invited anyone to come forward and become the President of EC 2009. A reasonable time was given (with a 10-15min break) for this but no one came forward.

        Above M.O.M. was duly sent to the BCS Community on 18.02.09. Therefore, the dissenting point raised by you in this regard is baseless. However, once more a copy of the same M.O.M. is attached herewith in same the filename, ‘MINUTES_OF_MEETING_AGM_-_16-2-09’ as it was sent out then for reference.

        May I humbly mention here that you were also present in that AGM and you witnessed the whole procedure yourself?

2.     Long before the AGM, a systematic official procedure to identify a new EC was set in place by circulating hard copies of a ‘Nomination Form’ in four successive programmes (Annual Dinner, Annual Drama, Annual Picnic and Saraswati Puja) in order to ensure that the Form reached the hands of most people. However, there was no response to or action on this endeavour from the community till the AGM and even till Debarshi became the President.

Above account, therefore, establishes that a fully constitutional and logical procedure was adopted to find out a new President.

It is a great pleasure to know that at last BCS has been able to find an able President for this year. Congratulations for the New President and congratulation to you in finding the new president. I always appreciated you as the president of the Ex- Committee for the dramatic way you lead the team all through the year.The Drama- Kenaram Becharam,The drama - Daibaddha staged by you. The dramatic way of announcing the date of AGM, and finally the dramatic way you announced the sudden discovery of the new President. As far as the constitution of BCS is concerned- the declaration of new BCS President should be declared in an AGM, and no ex president has the authority to declare this by sending an e mail. So this was clearly unconstitutional. Anyway this might have been a part of the drama. I hope you will be kind enough to publish this mail in the group so that it would come to notice of all the well wishers of our new president.

Dear Mr Dutta,

                             I have been  waiting to get the reply of my second mail dated 14/03/09 sent to you in which I categorically mentioned where things went wrong.  Still I do feel that what you did was compelling by the situation but not constitutionally correct. So far so I did not get any reply of that mail. I am surprised at your silence. In my first mail I used the term “Dramatically”. I am really sorry if the term has hurt you.

 

I have been watching the reactions of the General Members of BCS since last few days.

 

1)      I have noticed that I have been accused by some of the honorable members , but should not we think that we are equally liable to send BCS to a critical condition every year by simply shrugging off the responsibility ?  Is it not better to treat the MOTHER early? Or should we neglect the MOTHER till she reaches Coma?   

 

Many other persons expressed their views and I think healthy criticism is always beneficial for the sake of an Organization.

 

2)      I was really shocked to read the mail sent by Mr T K Sen. I  don’t know him and had never had any interaction with him. His  attitude, choice and application of language depicts his class and status. Sorry ,I can not draw myself to that status by reacting against his mail. The entire mail seemed to be an outburst of personal grudge.  I would strongly demand a public apology from him if not to me, to the honorable members for polluting our society in the BCS YAHOO GROUP as soon as possible.

 

3)      Some of the members accused me that my intention towards BCS and towards the President had been unproductive or destructive. Mr  Dutta, In this context I really expected you to respond. But unfortunately you have been silent. Therefore, I am compelled to send some documents related to you without your consent as attachment with this mail.

 

4)      As I stated in my earlier mail that I was one of the few members present in the last AGM. I found myself the only person to  put some constructive proposals before the 2008 BCS Committee requesting them to pass on to the ensuing committee. I was appreciated by each an every member of the Committee. There was no mention of this in the MOM of the last AGM. “Formation of an advisory board consisting of all the Ex Presidents and senior members of BCS” was one of my proposals.

 

5)      BCS official website has provided us an opportunity to go through the entire BCS constitution. I found nothing wrong in having some basic ideas about the constitution of the society to which we belong.

 

6)      It is very nice to see that some of the Prestigious Members intervening this debate. I hope BCS would come out of Sleep Apnea Syndrome very soon. It is our pride to find BCS in its own heritage ,culture and glory. FINALLY I AM AGAIN CONGRATULATING  MR DEBARSHI BANERJEE FOR COMING FORWARD TO EXPRESS HIS DESIRE TO SHOULDER THE RESPONSIBILITY  AS BCS PRESIDENT FOR THE YEAR 2009.

 

I hope this mail wont usher any more debate, wishing the ensuing BCS Committee ,  all the members of BCS and you, respected Duttada the best. Hoping we would be able to site an example of harmony, love, fellow feeling and integrity  before our future progeny who will be watching this media very soon.

Dear Dr. Deb,
 
It seems you have enough time to write such long mails which is not only un-productive but also damaging. We are in a critical situation now where BCS is in verge of collapse. I strongly protest the way you have used the adjective against Dutta da.
What constitution you are talking about in a critical situation like this ?
If only 10% member attend the annual GBM and nobody comes forward to take over , any step or any anouncement to declare a President to save the situation is highly constitutional.
You are a doctor , so I will give you one example.
When the option comes to save the life of either the pregnant mother or her un-born baby , the doctors opt for saving the life of the mother. Similarly, in this case the one and only option is to save the BCS.
 
Please try to understand the gravity of the situation and  help to form the new committee.
