gull identity help please

[Ferne Dalton]

Taken in December 2008, Victoria, southern tip of the island. I would have said Herring but I have three different poses and can only see a dark, smudgy eye in a smudgy pic for all three. I do have the tail if needed, but this looked like the best for what I assume is the definitive part. Thayer's or something else maybe?
