不是在中華民國内民主轉型，而是自組政府

 

昨天3月23是台灣人自選總統30週年，加上1992年就自選國會議員（立委），合起來就是聯合國憲章第76條b款的self-government（見附件1），台灣人「自組政府」已經30週年，事實上和憲法領土在中國大陸，領土不含台灣的中華民國已經無關。

 

昨天同時也是密謀竊台蔣介石掩護陳儀免被撤辦79週年（見附件2）。79年前，蔣賊為了竊據台灣而屠殺台灣人雖暫時得手，49年後台灣還是回到台灣人手裏，賴清德只說這是「民主轉型」，實是大錯。https://www.president.gov.tw/NEWS/39900。因為這樣說，好像台灣政府仍由中國人組成，1996年以前是專制，以後是民主，但事實並非如此，法律根據也不是如此。

 

根據1945.6.26制定，同年10.24生效的聯合國憲章第77條b款，自敵國（例如日本）分離的領土（例如台灣），應由聯合國託管（見附件3），而託管最後的目的在使之自組政府或獨立，規定於上述聯合國憲章第76條b款。

 

台灣因自1945.10.25起就被中華民國竊據，1947.3.3台灣人到台北美國領事館轉向聯合國請願，照上述聯合國憲章託管、獨立，蔣介石知道後展開大屠殺，陳儀、彭孟緝、劉雨卿等走狗事後都升官（詳見228事件調查報告https://www.taiwannation.com.tw/T019/cairo019.htm）。依聯合國憲章台灣託管、獨立一時受阻，台灣由中國選出的總統、立委等統治，直到1996年。

 

之後，總統、立委全由台灣人選出，就是聯合國憲章第76條b款的self-government「自組政府」，國際法上有人稱為「事實獨立」，但因仍用1946年中國人在中國制定的憲法、國號、國旗等，所以，法律上尙未獨立。因此，現在只要丟掉中華民國憲法、國號、國旗等，就不必和中國糾纏不清，若不丟掉，想繼續糾纏，也是台灣人自己的選擇。

附件1 聯合國憲章第76條b款規定，託管最後的目的在使之自組政府或獨立。

United Nations Charter, Chapter XII:

Article 76

The basic objectives of the trusteeship system, in accordance with the Purposes of the United Nations laid down in Article 1 of the present Charter, shall be:

1. to further international peace and security;
2. to promote the political, economic, social, and educational advancement of the inhabitants of the trust territories, and their progressive development towards self-government or independence as may be appropriate to the particular circumstances of each territory and its peoples and the freely expressed wishes of the peoples concerned, and as may be provided by the terms of each trusteeship agreement;

 

附件2  蔣日記原本。1947.3.23 中國國民黨3中全會，旅居中國上海的台灣同鄉會提案，要求撤職查辦公俠，即陳儀（當時已辭職），蔣介石駡台灣人，不負責，只求報復不問是非、不顧大局…..蔣賊作賊心虛。因他與陳儀狼狽為奸，偽造開羅宣言，以此假權狀竊佔台灣，若辦陳儀，火會燒到蔣介石自己。

Article 77

1. The trusteeship system shall apply to such territories in the following categories as may be placed thereunder by means of trusteeship agreements:
1. territories now held under mandate;
2. territories which may be detached from enemy states as a result of the Second World War
