My Dear Friends,


The success in 1616-1684 DA case has given a high moral boost to all of us .  We had all the praise for the Judiciary on a  jubilant note !  
Quite obviously, we have taken this success as the "pilot signal" to  the forthcoming 100% DA case too......  

But the verdict was directly contrary  to our high hopes, which came like a bolt from the blue....  
In distress, We started blaming the same judiciary with different tone and tenor.... 

The above are two sides of the same coin.....  

Some  of my friends have been pessimistically expressing their anguish that we have no other recourse but to surrender with little hope....  

Let us not forget that we all together, constitute as an integral part of the system. We have got to fight out till the last chance. 

This communication of mine is meant for such of those who are in a distressed mood.....(The following illustration speak by itself......)

Episode-1:

When we were under British Colonel rule, Late Sir C P Ramaswamy Iyer was a legend jurist  practicing  in the then Madras Presidency.  In one particular case, He went on arguing extempore citing several settled cases in support the stance taken by him for a quite long duration.  Having listened to CPR Iyer for quite a long duration, the Hon'ble Judge lost his patience at one point of time to say (pointing out at his own  ears):-

"My dear learned Counsel,  What all you have been saying  are  just entering into one ear and leaving from the other"

Sir C P Ramaswamy Iyer replied in spontaneity saying:- 

"Quite obvious My Lord !  when there is nothing in between to obstruct !"


Episode-2:  

When I was working at Hyderabad, during those turbulent period,  when our organisation -viz: Syndicate Bank Officers Association (SBOA) was dragged to Court Halls in a deliberate attempt to scuttle its functioning at the behest of the then  management of the Bank.  

Many number of cases were filed against our organisation - both civil/criminal.  In one of the cases the management was successful to get an injunction order appointing a "COURT RECEIVER" to manage and conduct all  the affairs of our organisation .

I was chosen to interact with our advocates to followup our various cases.   During those days, I used to sit along with our advocates late nights to draft counters. I do very much remember that we had finalized our counter at around 04.00 AM  to file the same in the AP High Court  by 10.00 AM on the very  same day.   

I am very much thankful to  our lawyer Sri xxxxx who sat along with me throughout  the night for completing the draft.  I am happy to share with you that  he is a Sitting  High Court Judge at present.  That was the commitment of our advocates towards their client. 

The said case came up  before a "two judge bench" for final hearing followed by the pronouncement of the judgement immediately there after considering the urgency of the case. 

During  proceedings, the counsel appearing for our opponents, has been arguing with irrelevant  points/citations,  in a bid to explain the judicial system of the country even.  Having listened patiently for quite a long time,   The senior Judge of the Bench finally had to  obstruct the counsel saying - 

"My dear learned counsel ! you need not remind us of the existing judicial system of the country which we are quite aware of -
- It's just like two quarreling cats approaching the Monkey for justice !"  

We were indeed astonished to hear such a "down-to-earth" remark  in the  open court hall - that too from the bench itself.  

Therefore, friends !  Let us keep faith in our system, our efforts bound  to ensure success ultimately.

I am unable to understand about commutation arrears,first I want to know whether DA is included in calculation of Basic pay for Pension,if not than why people are asking Commutation on DA neutralization?
Any clarification by seniors will highly be appreciated

Dear Sir, Do you know our finance minister is an advocate? How can he understand our clear cut case? Everybody know that pension fund pertains to us retirees and not to Banks or any govt. Do you think finance minister is not aware of this most important point. The govt. is not ready to give our natural/legal right so like political false excuse the govt. advises IBA to pose excuse of banks financial very sick condition to which a laymen would always believe. We sufferers are dumb founded against this foul play. Even judges gave wrong judgement at the behest of govt. pressure which is very clear. To devide and rule 13/2/18 judgement was got to deliver (which must come in our favour). Only god can save us from everything wrong in this country!!! Why 23000/-millionaires runaway or made to runaway? SOCHO
