1.Tax exemption on contribution @ 2.8 times of revised Nov 2007
Salary, by existing employees,towards so called "Pension Fund Gap" has
so far not been granted.
The above point was raised by AIBOC vide their letter dt.10th May
2010,addressed to IBA,requesting them to obtain Special Permission
from CBDT to exempt entire contribution to pension fund from payment
of tax.So that the recovery made from existing employees @ 2.8 times
of revised Nov 2007 may be treated as superannuation benefits and
exempt from recovery of tax under TDS.
2.On one side, number of existing employees as well as Retirees (Pf
optees) have moved Writ Petitions, through various High Courts in
the country, against the unjustifiable and illegal recovery of 2.8
times of Nov 2007 salary and 156% PF from retirees to wards Pension
Fund Gap.
Pension fund Regulations 1995 stipulates on contributions and
management of Pension Fund by employer.
Employees/Retirees have no obligation to contribute towards 'Fund
Gap'.
3.On other side AIBOC, make request to IBA through their letter,to
seek tax exemption of entire contribution,where as it is fact that
AIBOC is one of the constituent who signed settlemnt dt 27.4.10,with
IBA for recovery of 2.8 times of salary from existing employees and
156% from retirees.
4. Central Board of Direct Taxes has to take decision on the subject
matter.Whether matter has been taken up by IBA is another question.
5.If contribution towards Pension Fund Gap is exempted from tax
payment , same cannot be restricted to existing employees only,since
'contribution to Fund' is the criteria and not contribution by
different groups.
First of all CBDT's decision is important,that too before the
Financial Year end.
