For Information:

01.Since this is not official circular of AIBPARC/CBPRO further clarification/authentication  on issues mentioned there in is required.

02.One such thing is about 100% DA issue of pre Nov.2002. pensioners.

It is mentioned under Sri.K.V.Acharya's name as:

"100% DA Neutralisation - DFS has sought some clarification on the recommendation of IBA"

03.It gives an impression that, if DFS has sought  any clarification as reported, on the subject of 100% DA neutralisation with IBA,
naturally a proposal on 100% DA to pre Nov 2022 pensioners should have been submitted to DFS.

04.No Apex Organisation of retirees mentioned this fact ( if it has happened) in their circulars so far if they have knowledge about the submission.

05.While the hearing on Updation of pension is tentatively  listed on 22nd April, 2022( SLP.5561/2016) before Apex Court for interim/final report on the subject from IBA, a question may arise here.

Will IBA submit a  separate report to DFS on 100% DA issue?

What about proposal on Pension Updation to DFS/or to Court?

Let us wait for official circular from Apex Organisation of Retirees, on the subject with details.

*AIBPARC/CBPRO MEETING ON 16th MARCH 2022 - WEDNESDAY AT 2.30 PM*

A Joint Meeting of Office Bearers of AIBPARC & CBPRO was held on 16th March 2022 at 3 pm at the CBOA Meeting Hall Jayanagar Bengaluru.

About 50 members were present in the Meeting. 

Joint Convener of CBPRO & President of AIBPARC, Respected K V Acharya Sir & Advisor to AIBPARC & former GS of AIBOC, Com. G D Nadaf Sir, Sri Nadiger Sir (RBONC) & Sri C N Prasad (AIRBEA) were on the Dais.

AIBPARC State Committee President, Com M R Gopinath Rao presided over. 

While extending a warm welcome to all the dignitaries & Office Bearers of our Affiliates, Sri A N Krishna Murthy, requested Respected Acharya Sir to touch upon the following issues, in his address among others. 

~ 100% DA Neutralisation to Pre Nov 2002 Retirees
~ Position of various Court Cases Reg. Pension Updation, Spl. Allowance, 
~ Implementation of Best HR Practices after amalgamation of Banks - Staff Welfare Measures, 
~ IOBRA Triennial - Staff Welfare Measures & Rumours of Handing over of Pension Fund issues to DFS, 
~ Need for formation of AIBPARC Women's Wing
~ Ensuing General Council of AIBPARC, etc.

@ Mr. G D Nadaf - Explained that the Pension Corpus is sufficient to take care of Updation of Pension & that once the last pensioner is no more & when there wouldn't be any claimant, what would happen to the balance available in Corpus. lauded the good work being done by AIBPARC/CBPRO & wished that the issues of Retirees would be resolved soon.

While fighting the 100% DA case in Court there should have been coordination between UFBU-Retiree association-Pensioners. There was a need to go through every aspect in detail. consult experts and brief advocates properly. While UFBU remains silent, each retiree association approached courts separately  and argued based on their limited understanding of the pension regulations. Lack of unity and coordination and not briefing advocates properly, too many impleaders and their advocates resulted in the failure of the 100% DA case. AIBRF also should have come out with an explanation as to why, in spite of appointing a high profile costliest lawyer, the case has failed.
Now we should accept the verdict gracefully and should not say judgment is wrong and judge has not considered this aspect etc. If judgment is not in our favour means we failed to present the case before court properly.

If the news that IBA's Special Committee headed by Respected Mallikarjuna Rao Sir has recommended 100% DA to Pre-2002 Retirees, is true, then our Retirees Association may arrange a Special Function to Honour Respected Mallikarjuna Rao Sir. It may be possible that Respected Mallikarjuna Rao Sir may guide us as to how to get Pension Updation also.

Dear Somashekara Sir!

Please go through the Supreme Court judgment, by which we lost our 100% DR case.

The court says that if pre-Nov. 2001 retirees are given 100% DR on their entire basic pension, they stand to gain an advantage over the subsequent retirees.

This clearly shows that the methodology for DR calculation being adopted in various bipartite settlements was not at all understood by the court. 

If court's understanding is correct, when the retirees of both 8th BPS and 9th BPS are getting 100% DR, is it amounting to 8th BPS retirees gaining an advantage over 9th BPS retirees?

Even if the lawyers (appearing on any side) try to make some wilful misrepresentations, can the court come to such a baseless/meaningless conclusion?

Updation as in the case of family pension can take care of this neutralisation amount to be considered as fair and justified. Concentrate on updation and not on neutralisation.Further DA is for that period's inflation and prices.Decades have passed.Sticking on this demand on technicalities will procrastinate the main issue and energy will be wasted in pursuit of it.Also many have reached heavenly abode and many are waiting on wings to fly away.  VR

Yes sir,  what shri Satyanarayana sir said is perfectly correct and our advocate couldn't present our case before Supreme Court correctly and this the reason why we lost case in supreme Court.

The fact of the matter is that the advocates could not make the Hon Judges understand a simple fact that what untapered DA (which means DA with full 100% neutralization) was being paid to all courts staff, govt staff as well as retirees since 1995 and to all Bank as well as RBI working / retired staff since May2005, was denied to a group of  Pre-2002 Bank Retirees 
- this section of retirees are still getting DA on Tapered basis and as a result, continue to hugely suffer financially.

Official circular on Meeting held on 16th March 2022, by AIBPARC Karnataka State Committee is furnished here under for information:

Earlier one communication issued by an  activist of state organisation mentioned, on clarification sought reportedly by by DFS on 100% DA issue, reportedly stated by com K V Achrya during the meet.Now this circular does not make any confirmation on that matter.

Now it is clear that this was another example of false message to befool senior pensioners!

 Sub : Organisational updates

.  1. Meeting organized on 16th March, 2022 by AIBPARC, Karnataka State Committee at CBOA meeting hall, Bengaluru.  A Joint meeting of the office bearers of various Constituents of CBPRO including AIBPARC was held on the above mentioned date and at the aforesaid venue.

 Nearly 50 members attended the meeting. Com. K.V. Acharya, President, AIBPARC & Joint Convener, CBPRO, Com. G.D. Nadaf, Former, GS, AIBOC and our advisor, Com. Nadiger of RBONC and Com. C.N. Prasad of AIRBEA adorned the dais. Com. M.R. Gopinath Rao, President, AIBPARC, state unit and a senior leader of our confederation presided over the meeting.  The initial address was offered by Com. A.N. Krishnamurthy, state secretary, AIBAPRC and a senior leader of the confederation.  The speakers addressed the gathering and apprised the house. Com. K.V. Acharya talked about the latest position of various issues affecting the interest of retirees and also informed the latest position of different court cases.   Com. BTR Reddy, senior leader of AIBPARC, proposed vote of thanks. The meeting was a grand success.    

2. 4th Biennial Conference of the Association of Pensioners of Paschim Banga Gramin Bank, an affiliate of AIBPARC held at Burdwan on 20th March, 2022.  There are approximately 700 pensioners and retirees in the RRB.  Out of them, 470 retirees have already joined our above quoted affiliate. The 4th Biennial Conference, organized at the Lions Club, Burdwan was attended by an enthusiastic crowd of 350. Senior leaders of AIBPARC and AIBOC addressed the gathering. The speakers included Com. Soumya Datta, General Secretary, AIBOC, Com. Somen Roy Choudhury, GS, All India UCO Bank Officers’ Federation and a very senior leader of AIBOC, Com. Srijan Pal, GS, AIRRBOF, Com. Asok Dey, President, AIPNBPRA and Com. Suprita Sarkar, GS, AIBPARC.  

We congratulate the office bearers and the members for holding such a successful conference.

Only meeting, meeting, circulars. letters. No action.
Only Sri.C.N.Prasad has filed WPs regarding DA and other cases and consistently monitoring the cases without seeking any publicity. Since physical hearing of cases  started in courts there are hopes of getting a verdict within a reasonable time.
We need not have much expectation of hearing on 20.04.2022 in SC. IBA has cleverly managed many such situations in SC. Further SC will be closed for summer holidays from 23rd May 2022 to 10th July 2022.
