Before reverting to your email, I would like to place one example:
I assume that there is a person by name Mr.ERS. Mr.ERS is very intelligent, handsome and has huge popularity. He has lot of close friends. His close friends say that he (Mr.ERS) is the next Prime Minister. His friends continues to say that Mr.ERS is a great personality and he is the next Prime Minister. He is extremely happy and he believes that he is going to be the Prime Minister, shortly. Unfortunately, he has also got friends like me. Who tell him that it is not possible, because Mr.Narendra Modi is the Prime Minister. He continues to be the Prime Minister.
Mr.ERS, starts cursing me stating that "eventhough I am going to be the Prime Minister, why are you saying that I will not be the Prime Minister". He feels that I am a negative person. He also accuses and tells me that "you would be very happy, if I do not become Prime Minister".
Mr.Iyer, there is no difference between Mr.ERS and you. I feel happy, if Pension is updated. I have been saying and continue to say that we do not have law on our side. Why I say so?
I am extracting from the Judgment of Single Judge in Singla's case, wherein what is the prayer is explained:
"The petitioners have a grievance that the Regulations provided for the application of pension in the manner that the Reserve Bank of India and Civil Services Pension Rules provided, but in the scheme which had been introduced, it has not provided for periodical updation of the pension with reference to the increase in scales of pay coming through various Pay Commissions' recommendations".
Which means, the Petitioners are only seeking Pension Updation with reference to the increase in scales of pay coming through various Pay Commissions' recommendations or
Reserve Bank of India and Civil Services Pension Rules provided. We have demonstrated with example that any revision by applying either of the formulae results in creation of anamolies. But, you are expecting order for revision of pension which creates anamolies or what is not possible. Perhaps, deliberately I am not listing possible adverse affect or damage any incorrect Judgment may cause as far as payment of our pension is concerned. After the Judgment, when I explain the possible damages, you will understand & will be with me. In any case, there cannot be any Judgment beyond what is prayed for. When my expectation is quite different fromthat of yours, my opinion will also be different. After all, I know my limitation and I am not expecting myself in the seat of Prime Minister.
