Dear Friends,

The above case has been listed for final hearing on 20th March 2025.We do not know whether  the above date may change or not.

Any way a  verdict in above case is inevitable ; let it be in our favour or against. 

At least IBA can stop harping on 'subjudice' often for not moving forward for discussion on the issue.

 A favourable verdict in above case is a remote possibility.Legal battle is on a lost case in Punjab and Haryana High Court,where the petitioners claim was sourced to clause No.12 ( in fact on a valid point)on updation and cl. No: 56 on residuary issues,under Memorandum of Pension Settlement,dated 29th Sept 1993.

While dismissing the case by single bench of P&H HC  in 2012 itself stated that:

"It would be open for the petitioners to make the demands for parity if they are so advised and use their bargaining skills through their associations and press for the reliefs though the mechanism provided under the Industrial Disputes Act. "

Let us hope that our major issue may be finally resolved through bilateral talks,shortly once the case happens to be  decided on above date itself!.

Updation of pension is our major and genuine demand.Let it happen without further delay.

Meanwhile IBA has  scheduled  a meeting on 13th March 2025 to discuss residual issues. Maybe this is because of the listing of the updation case and announcement of strike. Since there is no convenor at present in UFBU individual notices have been sent to unions.

Mr. Mohan better keep your views with you. The MOU and subsequent regulations were framed as per CCS 72 and that will be upheld by supreme court.

Mr Chandra Sekhar babu,

Pl go through the verdict of single bench of Punjab And Haryana High court first.
On reference of CCS pension rules under Regulation 56 of BEPR,1995 verdict says as follows:

Quote:

“56. Residuary provisions: In case of doubt, in the
matter of application of these regulations, regard may be
had to the corresponding provisions of Central Civil
Services Rules 1972 or Central Civil Services
(Commutation of Pension) Rules, 1981 applicable for
Central Government employees with such exceptions
and modifications as the Bank, with the previous
sanction of the Central Government, may from time to
time determine.”

"It can be noticed that the Bank Regulation was not making any
incorporation of either the Central Civil Services Rules or the
Reserve Bank of India Pension Regulations but merely provided that
in the matter of application of these regulations, regard could be had
to the provisions with such exceptions and modifications when there
existed any doubt in the manner of the application of the regulations."

"This Regulation 56 could not, therefore, be treated as making
possible certain benefits which the Reserve Bank of India's
Regulations or the Central Civil Services Pension Regulations
provided for"

13th meeting between iba and ufbu should not end up deciding another date to discuss retirees issues. The time frame of 6 months is already over, as per bps dt 8th mar 2024. They must atleast finalise da merger at 8088.
Reg Late Singla case, which is listed as 18, let us hope it will be taken up on 20th. Since the judiciary does not have any accountability and commitment,  especially when the cji, who made controversial decision in unduly postponing cases and who is on the verge of retirement, only a hidden force can bring justice to pensioners.
