Mr.CHV has every right to take legal action against Mr.Murthy. One can question Unions and leaders for delay in resolving issues but personal attacks, accusations without evidence should not be made. If what mr.CHV disclosed is true then Mr.Murthy will face consequences.

But there are other 750000 pensioners who are silently searching for answers to questions 1. Why there is delay in resolving issues like Updation, DA merger. Pension on special allowance etc for the last 25 years. IBA/Banks are not communicating with retirees. While CHV has the constitutional right to take action against Mr.Murthy, it would have been fair if CHV had spared a few words to address these questions in the letter.

These questions do have answers but these won't be palatable to the pensioners, to say the least. Hence, they are not being answered under the hope that the pensioners will soon get too tired to pursue the issues and reconcile to their fate besides learning to keep content with what they get. 

That IBA is inclined to grant any new benefit to Pensioners ONLY IF IT IS COST NEUTRAL is enough indication for the shape of things to come. Unless there is a political intervention to do some justice to Pensioners, the situation will not change.

It is misfortune that some ppl are supporting chv, only God need to give justice to chv, the sooner the better. As reg murthy garu, nothing happens, bcz our courts took 20 years for genuine sr citizens issue, nothing will happen to murthy garu, since he did it for others snd God knows better that than others.

The agrived retirees have right to question the UFBU leaders for not getting pensioner's issues resolved in time bound manner.
At the same time nobody has right to make personal and baseless allegations and character assassination of any leadership.
It is unfortunate that no retirees associations have succeeded in achieving our pending issues resolved .Shri D .S.Murthy is senior and matured person who is relentlessly echoing our plight is requested to avoid controversial writing against anybody and close the issue amicably with CHV with mutual respect and understanding.

What is the issue between Shri D.S . Murthy and CHV the general secretary of AIBEA.
CHV claims that Sri Murthy has defamed him by making false allegations which are baseless and provocative and involved in corrupt practices.
This is the bone of contention.
Is it necessary and right to make and pricpitate the matter?
A I B EA is the chief architect of pension scheme and succeeded in achieving it against the stiff opposition from all the constituents of UFBU.To day we are getting some pension for managing the day to needs.
No doubt we need updation and increase in pension.
This is the responsibility of UFBU to successfully achieve pension updation.
Why we should blame and make baseless allegations and indulge in charector assassination of AIBEA leaders.
Will it resolve our pending issues?
Therefore we have to be prudent in our communications any totally avoid such writings.
The big all India retirees associations also failed to convince the UFBU to successfully achieve pension updation.
As individuals what we can do?
As on today we are getting pension+ ex-gratia through bipartite negotiations between IBA and UFBU.
We have to request and pursue the pending issues through UFBU only.
The issues are very important.But writing against anybody will not help the retirees to achieve pension updation.
Therefore we have to pursue through all available Avenues with sofistication and be polite and dignified in our approach.
I am sure Shri D S.Murthy beeing learned and metured will   take care and resolve the issue With CHV in amicable manner as it deserves with out further pricpitation.

Mr.Satyanarayana whatever views Sri D S murthy had expressed, 90% of pensioners have also expressed such opinion all over the social media. But the language Sri D S Murthy had expressed is objectionable.

1. General opinion is UFBU is in collusion with IBA to deny benefits to retirees.

     UFBU silence on iBA actions support this opinion.

      While signing the EX gratia agreement it was agreed that the same would be reviewed every year starting from April 24. Few pensioners were happy that if  Ex gratia reviewed some financial benefit would be available. But IBA letter to CLC it is evident that Ex gratia was reviewed in consultation with UFBU which means UFBU agreed with IBA that no improvement is needed in Ex gratia.

 UFBU leaders with 6 decades of experience are well aware of legal position that mere pending of a case does not in any way bar negotiations between IBA and UFBU to discuss updation unless there is a stay from any court. But UFBU leaders  agreed with the IBA claim of sub judice without any protest.

There are small committee resolutions that permit updation as per RBI pension structure.

But IBA filed an affidavit before SC claiming that there is no provision in Pension regulation.

Why is UFBU  not protesting this even after RBI pensioners got updation twice although their pension regulations do not have provision for Updation.

UFBU blocking Updation and other benefits

On 08.03.2024 IBA and UFBU signed minutes agreeing to amend pension regulations to make provision for Updation in every settlement, merger of DA etc. But though 18 months have passed, UFBU is not taking any action to implement resolutions.

Though IBA is using one pending case in SC as an excuse to delay discussions on updation, UFBU itself is filing another case intentionally to further stall the discussions.

Often claiming fund shortage without disclosing cost.

Though the cost is a few hundred rupees per pensioner not taking up merger of DA issue for last two decades. Signing Special allowance settlement making pensioners lose a few lakhs of Rupees during their lifetime.

Majority of pensioners are expressing their resentment against UFBU on above issues.

I expected C H V would offer some explanation on these issues in his notice to CHV.

What Shri Soma Sekhara has stated is 100% true. He has beautifully explained the present situation. Shri D S Murthy is one of the disenchanted pensioners who are facing an onslaught from IBA, with a UFBU side by side. Shri Murthy has stated the facts but the language used by him not correct.

Nevertheless the UFBU should do a soul search, as to the treatment meted out to the senior retirees, with IBA's patronage. Instead of sueing the hapless Shri Murthy the UFBU can set right the anomalies and do something to make the lives of retirees comfortable one.

All the issues raised by Mr Sekhra are pending for several years now. The Unions/ associationS are supposed to look after the interests of employees/ authorised to discuss and try improve the benefits to retirees.

Does it even remotely appear that the unions/ associations can take a high moral ground for having justified their moral duties.

Issues raised by Mr Murti also on behalf of pensioners are all justified. Mother of demands - Pension updation not done since so many decades and our friend still suggesting for having patience.

Facts are known to everyone.Thousand if not lakhs of our friends have left for heavenly abode waiting for something good to happen. 

Like for example, I am 75+( MMG-2 pensioner)having taken vrs in 1994 ,am compelled to shell out my more than three months pension for taking mediclaim policy of IBA with max coverage and as mentioned and my wife suggesting from different ailments. Had to borrow money to pay premium.

Can CHV take a high moral ground and justify the act of COMMISSION by UFBU 

Steps may be taken to have the matter resolved and UFBU/AIBEA should take up serious steps for achieving the results and be transparent.

At the outset I thank you for your enlightend and detailed information about UFBU totally ignoring the legal benefits which are due to retirees.
In every bipartite negotiations they UFBU add pension updation issue and ignore to pursue to achieve pension updation and continuously postpone the issue without giving any serious approach for achieving it.
This is known to all.
I completely endorse your voice that the AIBEA which is the architect of pension scheme under the able leadership of late com Tharakehvar Chakraborty signed the agreement facing stiff opposition with in the UFBU.
Red salute to him.
To day we don't have such gegantic leadership in any constituent members of UFBU.
Com CHV and AIBEA and all consultants of UFBU takes firm stand and threaten IBA that they will go on agitation if the demand of pension updation is not resolved the IBA and the government will succumb and sign the pension updation agreement.
Here comes who can force or influence the AIBEA leaders to plunge into serious approach to sign pension updation agreement?
Coming to social media views nobody has control.
Our target is to achieve retirees issues are resolved.
Making allegations and sarcastic comments against anybody will not bring justice to us.

Sub:- Blatant violation of signed agreement/settlement .

I’m reproducing hereunder the relevant portion of the agreement/settlement arrived at and signed by all of you on 8th March-2024:-

Minutes of discussions held between IBA and AIBEA, NCBE, BEFI,NOBW and INBEF.

Whereas a settlement has been arrived at on 8th March, 2024 on the charter of demands submitted by the unions and

Whereas some of the issues and demands raised by the unions could not be taken up for discussion and resolved, and

It is hereby agreed between the parties that the following issues and demands raised in the charter of demands shall be discussed further to reach a mutually acceptable and amicable resolution of the same within a maximum period of six months from hereof :-

No.2.  Updation of pension for past retirees .

Provisions to be made in the Pension Regulations to provide for periodical updation of pension along with wage revisions/ settlement/s. 

No.3:- Improvement of pension scheme.

No. 6:- Extending exgratia to pensioners of private banks.

No. 8:- Premium of medical insurance policy to be borne by banks. 

No.9:- Improvement in group medical insurance policy. 

No.11:- DA scheme for all pensioners to be at uniform index of 8088 points.

No.13:- Inclusion of Special Allowance for superannuation benefit .

These were the written and signed agreements/ settlements where all of you have put your signatures . As per your own agreement, an amicable settlement should have been reached with six months , means within 8th September-2024. Now would you please look at your calendar and see that you did nothing to implement even a single  one of the list during one year and one month ! Would you please offer your explanation for your deliberate failure to honour your own agreements ? If the retirees ask you this question , you get irritated and use abusive words. 

If the retirees feel that it was a sheer secret understanding between IBA and yourselves, then would it be wrong ?

You do not allow the retirees associations to negotiate on their issues but do yourselves,  a plan which might have been designed by IBA. May I remind you  that the retirees are not your members and you cannot represent them  ? 

 

Bank Employees pension scheme is the only and unique scheme in India, may be in the whole world where for payment of retiral benefits the employers  need not spend a single rupee. For getting pension, retirees  have built a robust fund which is ever escalating every year, touching now over Rs.4.57 lakh crore ! 

In the same country , pension is paid to central and state Govt employees from budgetary allocation, same way pension is paid to MLAs/MPs/ministers, judges , military personnel from exchequer and their pension is regularly updated along with wage revision or by raising hands . But for bank pensioners though banks will not have to spend anything from their profit & loss account , pension updation is not agreed due to only arrogance of power. 

You are requested to just calculate how much financial burden has been taken by the banks since 6th BPS to 12th BPS while the pension remained stationary during all these years since  inception of the scheme in 1993. Don’t you feel how you are failing to the retirees but you want them to silently accept your failure/ negligence without uttering a word . 

You are more interested in 5 day banking than settling the  pensioners burning issues which you undertook to resolve within September-2024 ! 

Very strangely, IBA’s senior advisor- HR& IR Mr Brajeshwar Sharma is citing all bogus and baseless arguments against pension updation case pending in Supreme Court even by an affidavit . He is functioning these days like above the CEO/ Dy CEO of IBA. He is advising the MDs of banks , interacting with DFS etc . But as  per his designation , he is only an advisor to IBA on HR & IR matters. CEO or Dy CEO should represent the IBA not the advisor. 

We observe that IBA holds periodic meetings with UFBU on so-called residual issues which do not include pension updation matter . 

Recently, we observed that two constituents of UFBU, viz AIBOA and NCBE came up supporting the pensioners’ issues but others are still silent. The reasons are best known to them. 

At the end, I leave it to your conscience and hope good senses will prevail upon you !!

I am not holding the brief for any one.  But, I request all those who finding virtues in what Mr.Sinivasa Murti Devalapalli to list the achievments or what he has worked during last two decades fo the benefit of Bank retirees, other than misguiding, misrepresenting or misleading Bank Pensioners and abusing UFBU, more particularly AIBEA/CHV.  It is upto him to defend and what he is stating is true, he need not fear.  It is not just the language, even facts are also untrue.  It is he who has to provide correct information to the Court and convince.  Writing in Social Media or supporting him in Social Media, does not help.

The fact is none of the 750000 pensioners including S C jain and Acharya and others can contribute anything

towards resolution of pensioners pending demands because of the following reasons.

We are not factory workers who only a few years back led violent protests in PF issues. We are white collared employees who can fight  by gathering information.

IBA is not communicating with retirees and none of the UFBU constituents have opened any channel/platform for communication with retirees,

Banks are directing us to IBA. IBA will not discuss with retirees. UFBU does not communicate with retirees.

Proceedings of BPS are not recorded, Whether UFBU had actually discussed issues in BPS as they report in circulars nobody knows. iBA claims Banks cannot afford updation due to huge costs in court but pensioners have no way to obtain actual cost details from banks to counter the same in courts.

Under these circumstances pensioners only can contribute by filing WP in courts, writing letters to DFS etc.

D S Murthy did file WP in 1616-1684 issue like Plalani and others.

We are supporting basic facts raised by Sri.D S Murthy and not statements like stooge, bootlicking etc

. It is nobody's secret that UFBU raises an issue in one meeting and forgets it in the next meeting.  demand like Uniform DA for all pensioners, celebrated silver jubilee in UFBU circulars but not on the negotiating table.

Latest assurance given a silent burial is demand for Rs.200000 insurance benefit for all pensioners.

Once again we repeat that we never support baseless allegations of personal attack on  UFBU leaders but  only basic issues raised by him. 

I feel things will become clear if UFBU leaders come out with a circular clarifying why residual issues are being postponed to the next BPS without resolution? Why were minutes of 08.03.24 signed by all unions and iBA abandoned?  These are the questions raised by retirees only UFBU can answer.

Till then status quo, Unions staying silent and retirees  active on social media asking questions to UFBU will continue.

Though unity is important which everyone knows, the different unions cannot exhibit any unity as there is one-upmanship and each one will fight for supremacy. Unless the leaders act without who, and work for the general benefit of the retirees, there will be respite for them.

In the interest of all stake holders.
It is clear that UFBU is least interested in handling our long pending issues.
It is also very clear that the victims are pensioner community.
It is also clear that the plethora of retirees associations are helpless in resolving the issues as they have no negotiating rights to deal with IBA.
Under these conditions and uncertainty all retirees including  D.S.Murthy and all stalverts should totally desist from indulging in denigrating any individual or UFBU leaders.
This fighting between retirees and UFBU leaders will never help us in getting justice to our pending issues resolved.
We r all at the fag end of our life.
All office bearers of all retirees associations jointly meet the UFBU leaders and appeal them to seriously negotiate our pending issues and resolve in time bound manner.
Unless UFBU take seriously and negotiate our issues will be pending as pending issues only.
Therefore the best way is to meet CHV and UFBU leaders and appeal them to conclude the negotiations for successful resolution of pension updation.
This is the only way to achieve retirees issues resolved.

Without getting other issues you have raised. at present, I wish to give one example of how misleading is taking place.

Since, I am one of the Respondents in 1616-1684 case, both before Hon'ble KHC & SC and was present in Court Halls on all the days of Hearing and aware who was representing whom.  This is an outstanding example of misleading Bank Pensioners. He was one among nearly 1,000 Pensioners.  It is true that he may be instrumental in filing one batch of WP. What happened later. He did not even engage Advocates in Appeals.  Case is won because of efforts of retirees from SBM. Vijaya Bank & BoB, lead by G Palani & others.  Please cross check SC website.

We are grateful to all those who filed WP in 1616-1684 and 5 year grace period issues and won successfully.

Because of their efforts we got arrears one lakh and above.

Though we are unlucky we appreciate the efforts of SBM commune in getting justice in the commutation recovery issue for SBM pensioners.

We are also happy to note that AIBEA has issued a circular confirming that Updation is their priority. Hope 

UFBU will pursue the matter effectively.

Also today is the date of final hearing in the LIC updation case in SC. LIC management has arrived updation cost of Rs.1 lakh crores.  A positive verdict in the LIC case may boost efforts of UFBU in our updation case also.

29 th October 1993 is a red letter day in the history of bank employees and retirees.Why?
On this date in 1993 the great and tallest leadership of AIBEA com Tharakehvar Chakraborty the the general secretary of AIBEA signed the introduction of pension scheme for bank retirees with retrospective effect or from 1st January 1986.
Red salute to Comrade Tharakehvar Chakraborty da and the entire bank retirees community should remember him and be greatful to AIBEA.

We should understand clearly what are the impediments in Pension Updation/revision/improvement...   

The impediments to be  substantiated and reasons to those impediments to made out clearly.

Without this - just are throwing stones in air only.

Why UFBU/AIBOC/AIBEA will be against the interest of the pensioners ?  Any benefit to them ?

Blame games doesnot bring us benefits for sure.

What are the impediments? 

1. There is no provision for Updation.

Neither Central Govt nor RBI/LIC rules/regulations does not have provision for updation.

Pension regulation agreement was signed by Unions and IBA. They can also  sign agreement  providing for Updation. Infact they had signed minutes on 08.03.24 agreeing to discuss and amend pension regulations which had been put to cold storage.

This is not at all an impediment.

2. Merger of DA@8088 points

   This is the first step towards updation.   At present merging DA@ 8088 points costs a few hundred Rupees per pensioner. IBA and UFBU during the last BPS had agreed to review EX gratia every year which had not been done. Merger of DA costs less than review of ex gratia. This could have been implemented,

3. Insufficient Funds

So what is the actual cost for Updation. 

An affordable scheme can be worked out considering the age of the pre 2002 pensioners.

Approximately Bank have to bear 2 times of the ex gratia they have been paying now.

Cost can be spread out for 5-10 years for making provision.

Management knows how to arrange funds.

Union duty is to negotiate for a reasonable updation scheme.

Now the real impediment.

IBA  has filed an affidavit in SC claiming 1. There is no provision for updation 2. Banks cannot afford updation.

 If they implement minutes of 08.03.24 IBA  affidavit become redundant. 

So IBA will never come to the negotiating table to discuss updation and postpone claiming sub judice.

Other alternative is petitioners of Singla case and UFBU should find out a solution by withdrawing the case in SC subject to iBA agreeing to discuss updation.

SC should pass verdict within next 6 months.

I do not think anybody is in a hurry to find a solution.

Some pensioners blame each other, some blame unions, Retiree associations conduct dharnas. Unions and iBA remain inaccessible to pensioners.

Pension issues – few points to ponder :

 

1.   Banks filed an affidavit informing that ‘there is no provision for updation’ .  That was in reference to the Writ – claiming that there is a updation clause 35(1).

2.   Further , writ claimed that there are enough funds in Pension funds and updation can be made without impacting P&L Account. In response to the above statement, IBA has filed written submission – that banks require additional funds for updation.

3.   What other reply we can expect from IBA.  In fact both the above claims of IBA are facts only. 

4.   Retiree officers (especially) are brain washed that –

a)   Pension Updation as per RBI formula  is their legal right

b)   There is a clause in 35(1) for updation after 2003 amendment

c)   There are huge corpus under Pension Funds – which can easily afford updation,etc

5.   What we want from UFBU ? to negotiate with IBA regarding updation ? – whatever they settle pensioners are not happy and blame even more – that UFBU is against pensioners and hand in glove, etc. (we have seen in exgratia implementation).  If one feels updation is a matter of right , ‘ how one can negotiate rights?’.

6.   The Singlas case and also Spl allowance cases – verdict may come in 2026 either way – which will make road clear for improvement in pension

7.   I am very much hopeful of Pension positive and good Improvement alongwith 2027 BPS positively.

8.    By that time, 

a)   both Singlas and Spl.Cases would have reached logical end.

b)   Most of pension optees would have retired from service

c)   Banks may shift from NPS to UPS …. 

d)   8^th Pay commission report will be out – lets see what will be done regarding govt pension revision this time

e)   Ofcourse, some  of us may not get the benefit – that is the tragedy.

9.   We pensioners are privileged in comparison with present NPS staff as far as retiremental benefits are concerned.  Naturally, there will be resistance /reluctance to improve pension much much further.  Certainly, Pension revision cannot come at the cost of serving employees – as the same will be resisted both by Banks and UFBU.

10.                 We should understand the reality/facts and stop blaming everyone from PM/FM/UFBU/CHV, etc – as without their help – we may not get any benefit.

I think, like me, yourself and Sri.Nirajan  are also Canara Bank pensioners.

I have been going through all your mails in this group and keep wondering at the painstaking efforts made by you to put forth your views, almost on a daily basis.

As expressed by me in my earlier mails,

IBA has revealed its mind on more than one occasion that it is not inclined to incur any additional costs on pensioners including marginal increases on account of revision of ex-gratia or merger of DR at 8088 points with basic pension.

This being the case, there is no scope at all for their agreeing to negotiate on updation unless prodded by the DFS,

as it apparently happened in the matter of 100% DA to pre 2002 pensioners.

IBA is also taking the stand that only UFBU can negotiate on issues concerning pensioners. But, UFBU's

interest in our issues has fallen sharply,

after it started functioning sans a convener due to differences among the constituents. They seem to be disinclined to pursue and clinch even minor issues like removal of anomaly in ex-gratia to pre2002 pensioners and uniform DA formula for all Pensioners. And, what is more, they are not even prepared to discuss with the pensioners' associations.

You seem to be of the view that updation may be granted at least to the pre 2002

pensioners, to start with. As you would remember, such a line of thinking was there in the minds of UFBU members at the beginning of 12th BPS talks considering the advanced age of those in the group and their having suffered heavily due to the tapered DA for 18+ years. But, this proposal was abandoned after the pensioners' associations took a stand that it should either be updation for all or updation for none.

Given its attitude towards pensioners,

IBA will definitely go in appeal in the unlikely event of the judgement in M.C.Singla's going in favour of the pensioners.

This, the pensioners, particularly those in the pre 2002 group stand very little chance of realising their aspirations.

Mr.Niranjan Sir,

Affidavit of IBA is not based on facts.  IBA aim is to win the case at any cost even if the affidavit is false. IBA filed an affidavit in 2023. But on 08.03.2024 when the Singhla case was pending  IBA signed minutes agreeing to discuss and amend pension regulations to make provision for updation in pension regulations in every wage settlement. IBA has not disclosed the fact to the court that it has the right to negotiate and make provision for updation as evident after signing minutes on 08.03.24. The minutes were not followed up because if pension regulations were amended iBA affidavit would have become baseless. 

IBA always argue Banks cannot afford the cost of updation.. But IBA and UFBU have never discussed and disclosed the cost. IBA and uFBU both does not come under RTI act. IBA does not communicate with retirees.

Banks direct retirees to IBA. So this information is withheld and petitioners are at great disadvantage to counter iBA arguments regarding cost which cannot be accepted as true without data. Can you say IBA argument regarding cost is a fact without any data.

IBA and UFBU argument is 

There is no provision for updation

Banks cannot afford cost of updation

PETITIONERS

Clause 35/1 provides for updation. Pension funds are sufficient for updation.

Both IBA/ UFBU and Petitioners are misleading 750000 pensioners.

IBA and UFBU can amend pension regulation at any time which they are n.t willing to do.

Pensioners are not fools  and are not asking for the  moon,Considering the age of pensioners IBA and UFBU can come out with reasonable and affordable scheme.

It is an insult to pensioners to claim that Pensioners are greedy and go on asking for more by giving an example of EX gratia. Mr.Niranjan Sir, almost every office bearers of all unions before ex gratia was announced, promised that they will ensure substantial amount of ex gratia So pensioners expectation was reasonable.

If a pensioner is getting ex gratia of Rs.3500, increasing it to Rs.7000-8000 per month will not be a burden as cost provision is spread out over 5 years. We have already experienced no DA hike for the present half year. So merger of DA and updation pension will protect existing DA. Employees do not have sole authority on income as the Bank is spending several hundred crores for write off. So allotting 2-3% out of profit for updation should not be a problem.

We also agree only IBA and UFBU can discuss and resolve updation.  But when? Pre 2002 pensioners are deprived of an increase in Basic pension since retirement. Will you exclude them?

I fully agree with what you have mentioned in para 9 of your letter.

The situation cannot be explained more elaborately. Until and Unless, at least UPS is offered to those under NPS (as against the demand for OPS) we can't expect any change in the attitude of UFBU towards pensioners' issues.
