I am a VRS optee from Vijaya Bank with pension option.(VRS.2000 Dec).Kly let me know whether
5 years has been added to your service as per IBA guidelines.i.e.notional weightage of 5 years of
service for VRS optees, which has been given in all banks except VIJAYA BANK.

              Even Associate Banks of SBI have not extended the benefit of adding 5 years notional service to  to pension to their svrs employees and  few of the exit option employees despite there is clear order from
 Honourable Supreme Court and IBA.The AIBOC and other members of United Forum have not helped the ex-comrades.

I have completed  18 years and 9 months before taking VRS in Jan2001 from Syndicate Bank . I have not got the benefit of 5 years inclusion in service for pension benefits. will I get this or not  Please clarify

I think your statement is incomplete. It should have been

"A minimum of 20 years of service is necessary for 5 years notional benefit and willingness from Management side to extend the benefit to its pensioners."

SBM has not given that benefit and I understand from this forum that there are few other Banks who have also not paid this to the VRS optees.

This is a fact that many banks have not extended this benefit to their employees but Sec-29(5) of the Bank employees pension Reads as under-
 

"(5) The qualifying service of an employee retiring voluntarily under this regulation shall be increased by a period not exceeding five years, subject to the condition that the total qualifying service rendered by such employee shall not in any case exceed thirty-three years and it does not take him beyond the date of superannuation."

Your clarification on the eligibilty for five years notional period to get the full pension, when the total service is less than 33years is absolutely correct. However, in the case of some banks who have not given this eligible benefit to the SVRS retirees, (even after the SC court judgement )is due to the fact these bank had clearly mentioned in their SVRS circular in 2000 this benefit will not  be extended to those persons whose total service is less than 33 years. In other words, what they implied in their circular was that full pension is payable only to those who completed 33 years as on the date of their retirement in 2000 under the golden hand shake scheme. This was the reason, why SC also has not included these banks in their judgement for giving this benefit. The interpretation given was that only after reading the circular only these people had opted for retirement under the scheme. I think one of such banks are SBM and SBT.  In fact this five year benefit was also to be given under the SC order only to those who filed the writ. But after seeing an attempt by the banks to counter the judement and prevent furthur petitions by the huge left over retirees, SC had passed the order covering all the banks, who had not mentioned this contra clause in their SVRS circular. That is how many SVRS who had  not filed any writ in the courts  also had the benefit. However the deviation from the original pension scheme, by the banks with regard to this five year notional period clause is unfortunate and the unions and assosiations have also not done anything to counter this at that time.  If I remember correct this clause was nowhere mentioned in the recent circulars by the banks when they announced the secone option for pension. It is really an unfortunate for those retirees in not getting this benefit.

dear members,
     why only SBM and SBT, our Canara Bank is also in the forefront by keeping this clause added after the original circular on SVRS. it is all by the supreme court judgement, our Canara Bank has fallen in line with othe banks in extending the 5 year notional weightage.  My point is when Canara Bank on the earth has extended the benefit, why these great banks like SBM and SBT are lagging behind not intelligible to my mind.  Let our comrades who are denied this to approach afresh courts citing the example of canara Bank who also imposed this clause in  additional circular , how atlast it has honoured the supreme court's judgement in extending the reasonable benefit. better approaching the courts with this example.
   I pray God our colleagues who are denied the benefit, to bestow his grace so that they also receive at the earliest.

Dear friends,

Associate Banks, Vijaya Bank and Allahabad Bank have not paid the benefit of addition of 5 years.  Vijaya Bank has not paid even though Mumbai high court ordered payment.  But they have preferred appeal in Supreme Court.

In response to letter written by our organisation regarding this issue, bank replied stating that the scheme referred in Supreme Court judgement is different from the scheme in our Bank.  Of-course, there are some differences in the scheme.  Those who have put in service of 15 to 20 years have not been paid pension and Pension regulations have not been amended so far after notification in 1995.  These facts have been admitted by the Bank in High Court during arguments.  

But, there is a silver lining.  We have also prayed for payment of interest and the management cannot fall back on Supreme Court judgement in respect of this issue. In the meantime, SBM Employees' Union has taken up the matter of payment of pension to those who have served for more than 15 years, but less than 20 years.  The Management has taken a stand that they would be taking matter with SBI and also suggested to take up the matter in SBI - SSBEA JCC.  Perhaps, banks are basing their opinion on Bank of India & Ors. vs O.P.Swarnakar & Ors. case.  The ratio of that judgement is not applicable in our case.

However, writ petition filed by 194 of us has reached final stages.  But, unfortunately, for reasons beyond control, like murder in high court premises around 1 30 p m, etc have delayed conclusion.  I hope, the matter has been completely explained.
