Matter was briefly heard, documents submitted by both parties were taken on record. Advocate for petitioner informed the court that a look at the charts ( page no 15 onwards ) submitted show that basic pension remain unchanged. However in the Year 2022 when Ex Gratia ( no DR ) was added.

 Advocate for PNB sought time to study the material placed on record and argue the case. *Court fixed 12 th March 26 for next hearing !!*

Our lawyer pleaded that pensioner are getting  BP +DA.  It should have been that pensioners are getting  BP(at the time of retirement) and DA. Basic pay is not enhanced by every pay revision.

The judge seems to have acknowledged the fact that pension need improvement. Judge repeatedly asking Bank advocates 'what are you paying other than DA".

So far 2 favourite slogans of IBA  Absence of updation in pension regulations and huge cost is not the subject matter of discussion before court.

Bank advocate has got opportunity to present his case on 11thMarch. Then he may bring up these arguments and  will try to convince judges.

If the judges have come to the conclusion that the Singla ji case for pension updation has no merit they coul have dismissed our case in first hearing itself.
The judges have understood that there is strong need and the demand of pension updation is justified and the UFBU and IBA combine have deliberately created by saying
1.There is no provision for pension updation.
2. It is subjudic to negotiate.
3.The  cost factor.
All the three reasons cited by IBA and where is paisa slogan raised by the leader are baseless and a deliberate attempt to deny, discriminate and an affront on the dignity of pensioners and a big assault on  the justice.We shall get favourable verdict and Sri Singlaji will rejoice the judicial victory and all advocated who support IBA and UFBU combine wrong and misleading interpretation will regret for their blindness.

The question is will Pensioners side lawyer be able to strongly convince Hon.Judge that for pension updation there is no need for provision for updation in pension regulations. Citing multiple updation in RBI though there is no provision for pension updation in their pension rules. Regulations can be amended later on.

Further Hon. Judge has given permission to parties to file additional documents. Pensioners should provide the detailed calculation chart of Updation applying the RBI formula.

IF IBA cites huge cost pensioners' side should demand that IBA provide details of actual cost of updation and provision separately, bankwise so that iBA cannot quote some imaginary figure.

Dhryv Mehta and his brother Tushar Mehta are most influential advocates.  

They are sure to come up with fresh dara and stronger attacks on 12th March.

So far Pensioners side advocates have done some food job, but not much impressive. They need to have clarity on what formula of updation they want.

The judges have called for pension paid in three  different time slots.
The pension updation as per 35/1 and appendix 1 shall be updated and accordingly the pension has to be revised..
As our pension regulations are based on RBI and central government pension scheme the updation case can also take place to have uniform pension updation in banking sector.
In all posbilities the updation
Will take place as per RBI formula to have equity and fair play and on the principles of Natural justice and to put an end decades old issue.
