Dear Friends,.

Once again Petitioner seeks adjournment of Pension Updation Case SLP(C)5561/2016 of late  M.C.Singla and ORs versus Union of India!.(earlier too) 


"The abovementioned matters is listed on 08.08.2023 before the Hon'ble Supreme Court in Court No. 8 as Item No. 21 The counsel for the Petitioner seeks adjournment of one week time for personal difficulty of the arguing counsel in abovementioned matters.'

Dear Friends,

01.While the case No.5561/2016 filed by late M.C.Singla & Ors V/s Union of India & Ors before SC on updation of
Pension  called  for hearing on 01-10-2021
before the Bench of Hon.Justice.Dinesh Maheswari 
& Ho.Justice Vikram Nath, 
Learned counsel for the petitioners has circulated a letter seeking adjournment with the submissions that the subject matter of these petitions and claim of the present petitioners is being examined by a Committee constituted by Indian Banks' Association on the instructions of the Ministry of Finance.
( not asked by IBA or GOI!)

Though learned counsel for the petitioners has sought adjournment for a period of four weeks but, looking to the reasons stated, the matters are adjourned bybApex Court for a period of eight weeks with liberty to required. the parties to mention for early listing, if so required.

02.Now  Adv.Sunny Chowdhary Advocate  ,for Petitioners has sought adjournment of above case  for one week .We do not know how court order would be.

Why petitioners( pensioners here) are delaying the matter in Apex Court often without  valid reasons ?

After petitioner filed application seeking a week adjournment, now.respondent advocate is.requesting two weeks adjournment as Solicitor general is.expected to argue case in next hearing and he is at present busy in.constitution bench PIL case.

MC Singhla case in Supreme Court came up today post-lunch.

PNB Management requested for adjournment for two weeks as the Solicitor General Tushar Mehta who will argue their case on their behalf was not available.

Our Senior Advocate Dr Manish Singhavi appeared and requested for a fixed date. The Court accordingly fixed up 05.09.2023 as next date.

Let us hope for the best.

It is most respectfully submitted that at the time of hearing the undersigned Advocate on Record for the Respondent No.4 ( PUNJAB NATIONAL BANK) will be seeking Adjournment for Two weeks due to fact that Respondent No.4 has instructed the undersigned AOR to engage Solicitor General of India to appear in this matter, however, the Solicitor General of India is pre-occupied at present before the Constitution Bench.

Kindly circulate this letter at the risk of the undersigned to the Hon'ble Judges hearing the matter so that their Lordships are not inconvenienced.

Dear Comrades, 
We were hoping against hopes that ultimately the Updation issue filed by Late  Comrade M C Singla of PNB  would get the opportunity of being heard after a long wait today (8th August 2023) in the Hon'ble Supreme Court. 

We from ARISE as an Impleading Party were fully prepared with all our preparations like Affidavits, Counters, Vital documents like Pension Settlement, post settlement Small Committee Minutes, Correspondences between IBA and Comrade Godbole as the then General Secretary of AIBOC, Petitions by Com.J D 
Sharma to the Petitions Committee of Rajya Sabha, Updation to RBI Pensioners and other relevant documents. 

I must say that Com. J D Sharma did lot of running around to coordinate with the original Petitioners PNB Retirees Association, our Advocate on record, our own Advocate Com Sewaram and  our Senior Advocate for articulating our case. He is being ably assisted by Comrades D K Hans and T R Subramanian.  They were keeping us abreast of all details and constantly in touch with Comrades K S Rangarajan and SBC Karunakaran and me and Com. Suprita Sarkar both by informing and consulting about the case .Though we were not expecting any Finality today but thought that the process for getting justice would start. 

But unfortunately the PNB Management, the CEO of which is also the Chairman of IBA requested the Hon'ble Court to adjourn the  proceedings as they wanted engage the services of a legal luminary as great Shri Thushar Mehta , the Solicitor General of Government of India. 
This Clearly reflects the highly despicable attitude of the PNB Management and IBA in regard to the of Updation of Pension. The large heartedness  that we saw on the issue of Updation of Pension for RBI Pensioners by successive Governors of RBI is sadly missing here . The decision of PNB Management to somehow deny the rightful entitlement  of the aged Bank Pensioners.
