Dear Sir,

I retired from Syndicate Bank under SVRS in April 2001. (28 April 2001).  My basic pension is Rs. 7880. Could anyone please tell me what will be my commutation arrears.

The information you have provided is not sufficient to calculate your commutation arrears. I am attaching one Commutation Arrear calculator prepared by me by which you can calculate your commutation arrear yourself. But are you sure that you will get the arrears at all?

Your present BP of 7880 is @ 1684 points. What was your BP @1616before revision done in last year.
You can  know it from calculation sheet for arrears paid in 2018.    

Also inform your date of birth.

Dear Sir 

I furnish herewith the details of my pension with a request to apprise me arrears of commutation.

Retirement date. 12/10/2004
DOB.                      29/12/1953
Basic pension.     5876
Commuted.          1958
Commutation.      283137

I had received arrears of difference in BP last year as Rs 16005 and interest thereon Rs 19315

My present basic pension is Rs10200 and total pension is Rs 30315

Please do the needful.

 As calculation sheet was not provided to us BP at 1616 point is not known.However BP at the time of retirement was 5876.DOB 29/12/50

Mr. Dinesh Kumar Sharma,

There are mismatches in your information.

  1. As per the commutation amount that you have received, your age is 53 plus (comm. factor 12.05) But as per your DOB and DOR, your age is 50 plus (comm. Factor 12.95).
  2. Considering your BP arrear as 16005/- your basic pension figure seems to be wrong. Its also not clear whether the basic pension amounts are including or excluding commuted amount.

Please furnish correct basic pension figures for April 2005 and May 2005 and the difference per month you have received.

Mr. Dinesh Sharma,
If you have retired in the year 2004, then you are getting fully neutralized DA on your basic Pension @ 0.18%. 
DR factor on your present basic pension is 18.36. Present DR slab is 1219 in your case. So, your total pension should be :
10,200 + 22380.84 (18.36*1219) = 32580.84 less commutation 1958/- = 30,622.84. 
You are entitled to commute a further  amount of RS. 1442/-(3400 - 1958).
Commuted value will be :
1442* 12.05 * 12 = 2,08,513/-
But it's upto your bank whether they will consider it or not. 
You have no relation with 1616-1684 controversy.

But I was paid arrears of pension in June 2018 as Rs 16015 and Rs 19244 interest thereon.It may be for the period from Oct 2004 (my retirement) to 30th April 2005.
(For six months 19 days) Our bank had not provided calculation sheets hence I presume that the arrears related to 1616-1684.

Please apprise your views with reference to above.

The huge difference between your basic at retirement and  basic at present can't be the impact of 1616-1684 difference. There must be some other reasons which you and your bank should know. The impact of 1616-1684 points is less than 20% in basic.  But in your case it is more than 70%. 1616-1684 arrear is applicable for those who have retired before Nov 2002. All who have retired between Nov 2002 and Nov 2007 are receiving DA @ .18% flat without tapering. 

You should visit your pension disbursing branch personally  to get a copy of your pension calculation worksheets.

Will Banks pay 8% int on 5 years benefit arrears which was due from 2001 but paid in 2009-2010.

Is this commutation arrears , due to difference in the factor for calculation of commutation, taken as on the date of payment instead of date of retirement.Hope this is applicable to 2 and option pensioners of 2009 also.Shall we to apply to individual bank managements claiming to pay the difference of commutation arrears.
What about DR arears based on PRE 1995,Appendix II.Shall we to claim this also with Bank management.If so is there any chart to calculate the difference as I am a 2009 Pention optee retired in 2000 under SVRS OF Bank of India.

It seems each retirees assn. has to file contempt petition to derive the benefit. But so far no PSB retirees assn. has moved an inch towards reaping the benefit either through management or through filing contempt petition.

Sir, IT IS REGRETTED THAT SUFFICIENT TIME This HAS ELAPSED IN SC JUDGEMENT BUT NO RESPONSE IS FORTHCOMING FROM ALL CONCERNED BANKS. EVEN RETIREES ASSOCIATION ARE NOT ADHERING TO THE RETIRES  PROBLEMS FOR THE REASONS BEST KNOWN TO THEM. THIS WAS BEST TIME FOR THE ASSOCIATIONS TO GAIN THE GOODWILL OF ALMOST ALL OLD RETIREES AND NUMBER OF  THEM ARE AILING.

IBA is a clever Sutradhar in Banking Industry. It is pulling strings so cleverly that BPS negotiations system has become ridiculous and childish and 9 militant Unions and two retiree organizations have become puppets.
THE IMPORTANT STRATEGY OF IBA ALL THESE YEARS IS TO SNATCH EXISTING OR BENEFITS PROVIDED IN STATUTORY REGULATIONS AND AGREEMENTS.
SO BOTH UNIONS AND RETIREES/PENSIONERS SPEND THEIR TIME, ENERGY AND RESOURCES TO FIGHT FOR BENEFITS ALREADY PROVIDED AND DO NOT HAVE TIME AND PATIENCE TO FIGHT FOR ADDITIONAL BENEFITS.
If we carefully analyze during last 20 years we are fighting for these benefits
1. Gratuity for 6th BPS retirees.
2. 50% Basic Pension and related Commutation arrears.
    and recovery in 15 years after credit of commutation.
3. 5 Years benefit.
4. 100% DA
5. Pension CRS retirees
So we spent 20 years fighting for these benefits which IBA should have provided from Day one of retirement/agreements. Had IBA done so the entire focus of pensioners  would have been on Updation and we would have achieved the same. As RBI employees/retirees got these benefits in normal course they focused on getting updation only and achieved success.
BPS SYSTEM
IBA is adopting same strategy in dealing with 9 militant Unions.
In last BPS 15% Wage revision was settled. So natural justice demands that in XI BPS wage revision is settled at least 18% if not more. But IBA starts from scratch again.
And  9 militant organization is fighting since last 2 years is to at least retain wage revision at last BPS and IBA has created such situation that  demanding even 15% is impossible task.
Wage negotiation for officers covered officers upto scale VII. But IBA suddenly withdraws BPS negotiation for officers V to VII. So officers Unions spend good part of negotiations just fighting for mandate up to Scale VII which was already there in last BPS and celebrating same as historic achievement as IBA agreed to withdraw that condition.
As Unions already exhausted their resources fighting for retaining existing benefits like mandate up to Scale VII and wage revision @15% which were already agreed in last BPS they will not demand anything more.

The Following Circulars are attached.
1. UFBU Cir No.8 dated 18.09.2019 regarding BPS proceedings of 17th Sep 2019
     between IBA and UFBU
2. Joint Cir No.6 dated 29.09.2019 issued by Four officers organization explaining why 48 hours strike deferred.
Contradictions in two circulars about status of BPS negotiations are glaring and we wonder which is true?
1. PLI- profit linked incentive scheme proposed by IBA.
In its cir dated 18th Sep 2019 UFBU informed as follows
From the UFBU it was informed to them that since the scheme and its cost are over and above the wage revision we agree in principle to discuss further and give our suggestions during the further course of discussions.
But Joint Cir of 4 officers organization claims as follows
The four officers organization have decided not to concede to PLI scheme as it is essentially Bank specific and not going to benefit total workforce in the industry uniformly.

2. UPDATION ISSUE
UFBU cir stated as follows
As regards updation of pension IBA stated this also would entail additional provision to the Pension Fund which needs to be examined in detail. We requested the IBA to provide details of the necessary data so that unions also may work out the cost implication through actuaries before discussing further on the issue.
But Joint Cir of 4 officers organization claims
We also took up revision of family pension and updation with facts and figures.
We wonder where did they got facts and figures when they did not have anything on 17th and decided to go for actuaries to find facts and figures.
However in Joint Cir they have given us some hope by stating
At the same time, no stone will be left unturned to realise all our
genuine demands including wage revision and improvement of service conditions and also the superannuation
benefits
.
We hope this is true and they keep up promise

The  retirees are least interested in the controversial circulars  issued by UFBU. We are concerned about our pending issues like updation of pension on RBI lines.To what extent the UFBU can fight for updation of pension etc  is only our concern. Let us not scratch our heads and waste our time on controversy subject .

Such contradictions directly affects us. This raises doubt whether they are actually raising updation issue in BPS or simply mentioning in Circulars that IBA said cost to be examined etc. This clearly shows how much they can fight for updation.

We thought IBA is master in twisting pension regulations/Agreements according its whims and fancies. But AIBRF has better skills than IBA.
AIBRF Stand on commutation recovery vide its letter dated 2018/058 Dt.16.06.2018
We therefore request IBA to issue specific guidelines to member
banks to give proper treatment to this aspect and pay the
arrears along with applicable interest to implement Supreme
Court decision as per its tenor and spirit. It will not be out of
place to draw your kind attention on the fact that as per the
extended provisions in the Central Civil Pension Rules and as
per earlier communication issued by IBA in the matter,
arrears paid on account of commutation are recoverable from the
pension in future after date of payment
AND COMPLETE U TURN VIDE ITS LETTER TO AICBRF  DATED 29.06.2018
1. IBA stand of recovering commutation in one lump sum is legal and in order.
2.  demanding DA as per Reg 37II is not proper as regulations are amended later on. By this AIBRF
    approves amending Pen reg retrospectively.
3. Still AIBRF arguing that SC has not issued any order to pay commutation arrears in respect of 1616-1684 issue.
No wonder AIBRF last 100% DA in SC.

Mr.Velayudhan Sir, I full agree with your views. You have started a new mission. Already few pensioners have agreed to contribute the same. I am sure more will join as days go by. So filing WP in HC may not be a problem.
But hardest part is preparing flawless case and arguments so that this should not end up  like 100% DA case.
AIBRF which monitored and also part of 100% DA case in SC all along was assuring that arguments were good and former CJ who argued on behalf of AIBRF has also assured us that judgement will be positive. But result was negative.
Lawyers should be briefed properly and all data including cost data, documents have to be collected and provided to advocates.Let this may take one or two months. But case should be presented without flaws.
We may have to take opinion and advice of experts inside Banking Industry and also eminent advocates.
First our focus should be on presenting case.
Then contributions and legal action will follow.
This is just my opinion.

Shri Prasad is already on the job and I agree with him that there is no need for another outfit now. Let us give shoulder to him in the fight and time is not far off, another CMD may be called to apologize. Let us wait for some more time as forming a new outfit is not a joke and requires a lot of spadework. And it is difficult to start from the scratch and instead support Shri Prasad who is already on the job.

My Dear Friends,

I am happy to share with you all ,  that our Management seem to have positively responded  and the process of calculation  for the  payment of arrears are in progress.  

Under the circumstances, all the eligible retirees ( 01 04 98 - 30 04 2005)  who received the 1616-1684 DA arrears last year  are now bound to receive much more than what they  had received already.

I am happy that all our efforts  through this 18-year long legal battle  are now bearing the fruits.... Thanks to Com. C N Prasad  who is  instrumental in filing the Contempt Petition besides all those valiant comrades who fought the legal battle for over 18 long years. 

 I once again express my Regards and greetings to Com. C N Prasad and other comrades who fought on the legal front .....and  I pray ......
Kanaka Durga Matha , abode "Indrakeelaadri - Vijayawada"  to Shower Her Choicest Blessings on all of us for peace and prosperity on this Auspicious Dassehara Festival.

Respected Mr. Prasad and others,

I am a family pensioner, my husband expired on 20th January, 2017. He was a VRS optee from 2001 from Bank of Baroda. He took pension under the Second Pension option in 2010. Is he (or in relation am I) eligible for this commutation arrears? Due to my age constraints I am unable to understand all these regulations and whether or not Second option pension optees are eligible for this commutation arrears or not. Just for your information no arrears were paid towards me for the last case of 1616-1684, citing the reason that for Second pension optees it was already fixed and paid at 1684 points. Is this commutation the same, Second pension optees are not eligible?


Following are the details of my husband:

Date of Birth- 08/06/1947
Date of Joining- 19/05/1971
Date of Retirement- 31/03/2001
Service Duration- 29 Years, 10 Months

I am also attaching the photograph of the aforesaid document herewith for your convenience.

Heard that SBIPA gives dual membership to the

Madam

Your pension had been fixed at 1684 points from the beginning as your husband had accepted pension on second option. So, there is no question of arrears for the difference between 1116  and 1684. Similarly, there is no difference of commutation due to that.
You can verify this from your worksheet. 
Your starting basic pension was 5561/- and one-third of 5561 is 1853/- on which you have received as your commuted value. But the commutation factor (8.82) is much less than what it should actually be. But that's a different matter. 
In short, those who got less than one third commutation are eligible to get the difference.

As per SC Judgement dt.28.8.2019 pension optees of 2010 under second option of pension are also
entitled to receive commutation arrears. I think SC ruling in case of of pensioner's death will apply
in this case since original pensioner died and you being family pensioner. I am referring your case to
our legal expert Mr.K.R.Ganesh Rao for his views and reply.

I would like to share an information regarding retirees outfit and its leaders.  One of the tallest leader from Karnataka of a largest bank retirees organisation commented that 

'we want to resolve issues by having discussions with management, but SBM Pensioners Commune leaders go to Supreme Court'.

We fought, won and got benefits.  But, leaders are still discussing.

Sairam  Sri Mukharjee, I have come in some of the group discussions in this group that the SC judgement says the commutation factor to be based on the date of retirement age but not based on the age at the time of payment/commutation. If this is correct ,then almost all 2 ND pension optees will get benefit, because for all of them the factor bass on the age in 2010 was considered instead of the age at the retirement. 
Please clarify Sir, it will help all the 2 ND option pension optees.

The so called leader should introspect himself the achievements made so for through negotiations eaither by UFBU or other outfits sofor.Let him continue negotiations and deliver justice to all eligible beneficiaries of Supreme court orders in contempt proceedings and DR at 1148 points with out making reference to our ongoing fight against the unwilling and indifferent bank managements who still refuse to accept and implement highest court orders to all eligible similarly placed beneficiaries .Let us ignore such waste fellows and carry on our legal battle against banks till the court judgement favouring us is totally implemented word by word and letter by letter.

I fully agree with you and we also cherish and respect and love as you do for us.There is no doubt about C.N.Prasad beeing held in high esteem which he rightly and richly deserves. This he earned it it through his commitment for the welfare and fighting for the cause of retirees wherever the bank management distorted  and respect  and implement pension regulations. The results what we see through Supreme court order upholding karnataka high court order and further  passing one more order in contempt proceedings is shining example of his success story .Now  he is continuously holding meetings in different centers educating retirees about  the benefits of Supreme court order and how much  the retirees have to get by way  of commutation arrears and DR arrears and there by howmuch increase in pension etc.He is also holding retirees meeting at Hyderabad also on 16th of this month. That is the hard work and his commitment towards the welfare of his retirees friends. Let us wish him all success in his relentless efforts in getting justice to all aggrieved members.

Not only the commutation factor but the actual  pension should have been started from the date of retirement from the second pension optees.  From the representation of Sm. Pratima Ghosh it is evident that although her husband retired on 31/3/2001, he received pension with effect from 27/11/2009. 

His age at retirement and commutation factor was taken as 64 and 8.82 in place of 54 and 12.05 respectively, thereby making him poorer by 71782/.

I think these are clearly in contravention with the Pension Regulation Act,1995. 

 It's also learnt that Banks have charged penal interest at a flat rate of 56% on the PF refund amount, irrespective of date of retirement of the pensioner. If it's true, then it's a severe punishment for the pensioner who retired just before excercising his/her pension option. 

I don't know whether there are any cases pending before the court challenging this  agreement. 

 It's true that IBA wouldn't have agreed to the second pension offer without those preconditions.  But, now it's time to lodge writ petition against the banks for violating the terms and conditions of Pension Regulation Act, 1995.

01.It is a fact that,for those who opted second option on pension,monthly  pension was paid w.e.f 27.11.2009,and not from date of retirement.

02.Commutation factor was   taken based on date of availment and not based on actual date of retirement.

03.Yes.There are cases pending in different high courts of the country,as of now,filed  by few such second pension optees,against collection of 56% of PF
contribution by banks( 2.8 times of salary from serving employees too)

04.As per information available no verdict have been found pronounced by courts  in such cases so far.

Respected sir  , I am retired under svrs 2001 from sbbj with 18 years service. I opted pension when pension scheme was implemented. Bank paid my pension and arrears from 27.11.2009 to 29.2.2016 on 14.3.2016 considering me second pension optee. I requested bank that I am pension optee since pension scheme was implemented. Bank paid my pension and arrears from 1.4.2001 to 26.11.2009 on 1.1.2017 .How I can know whether I am eligible for 1616.1684 da diff arrears as per SC order dated 13.2.2018 and 28.8.2019 because I didn't get any arrears. Please reply sir.

What you are telling is absolutely correct. Banks Mandatory , the so called IBA AND UFBU for both Bank Employees  Unions and Officer's Association are played havoc in the Pension Field. All Courts told that both IBA AND UFBU/ OFFICER'S ASSOCIATION have no Statutory FORCE TO MEDDLE THE PENSION REGULATION 1995. But both played a long series of games and now look at for just 615 SBMPC PETITIONERS , THEY PAID INTEREST ALONE FIVE CRORES AND SEVENTY LAKHS . TO WHOM SHOULD BE FIXED THE RENSPOSABLITY FOR THIS AND THEY SHOULD BE PUNSHIBLE , IS IT NOT ???AT WHOSE FAULT SUCH A HUGE INTEREST IS HAPPENED TO BE PAID BY THE BANK. IF YOU CALCULATE THE INTEREST PAID BY ALL THE BANKS AND YET TO PAY IN THE FORM OF COMMUTATION ARREARS INTEREST AND D.A RELIEF.INTEREST BY ALL BANKS. THE GAME IS NOT OVER AND THEY HAVE YET TO SEE THE MAIN FILM , as quoted by our 'BELOVED C.N.PRASAD Jee . THE GOVERNMENT SHOULD FIX THE ROOT CAUSER FOR ALL  THESE THINGS HAPPENED. And again by making plunder mistakes by not fixing the basic Pension from the date of Retirement for the second Pension optees and fixing D .A under tapered formula are all shows their Strength and arrgoncy and they think that they are super human and no one can stop them and what ever way they want and they can do on their whims not even govt.come in their way. At present this is what is going on and on. What we don't understand is how these things are happening by isolating both the govt. and the Banks . Stil they have not learn any lessons out of these outcomes and still they are going on their path with out carrying any bodies , I mean including Hon'ble. Supreme court. The Affidavit filed by the Bank speaks their capabilities of doing anything and not carrying the APEX COURT'S ORDER. so.. God only save us from this IBA and UFBU.

All Courts told that both IBA AND UFBU/ OFFICER'S ASSOCIATION have no Statutory FORCE TO MEDDLE THE PENSION REGULATION 1995. But both played a long series of games and now look at for just 615 SBMPC PETITIONERS , THEY PAID INTEREST ALONE FIVE CRORES AND SEVENTY LAKHS . TO WHOM SHOULD BE FIXED THE RENSPOSABLITY FOR THIS AND THEY SHOULD BE PUNSHIBLE , IS IT NOT ???AT WHOSE FAULT SUCH A HUGE INTEREST IS HAPPENED TO BE PAID BY THE BANK. IF YOU CALCULATE THE INTEREST PAID BY ALL THE BANKS AND YET TO PAY IN THE FORM OF COMMUTATION ARREARS INTEREST AND D.A RELIEF.INTEREST BY ALL BANKS. THE GAME IS NOT OVER AND THEY HAVE YET TO SEE THE MAIN FILM , as quoted by our 'BELOVED C.N.PRASAD Jee . THE GOVERNMENT SHOULD FIX THE ROOT CAUSER FOR ALL  THESE THINGS HAPPENED. Not following as per the Pension Reg. and  fixing Basic Pension not taking the date of  retirement for calculation purpose , fixing by going back many years for fixing D.A at 1616 PTS. instead of  1148 PTS. , Denying five years benefits, calculating commutation and D.A on their own will by Amending the P.R THRO ' JOINTS NOTE  etc... And again by making plunder mistakes by not fixing the basic Pension from the date of Retirement for the second Pension optees and fixing D .A under tapered formula are all shows their Strength and arrgoncy and they think that they are super human and no one can stop them and what ever way they want and they can do on their whims not even govt.come in their way. At present this is what is going on and on. What we don't understand is how these things are happening by isolating both the govt. and the Banks . Stil they have not learn any lessons out of these outcomes and still they are going on their path with out carrying any bodies , I mean including Hon'ble. Supreme court. The Affidavit filed by the Bank speaks their capabilities of doing anything and not carrying the APEX COURT'S ORDER. so.. God only save us from this IBA and UFBU.

Mrs Ghosh, Namashkar. My greetings on the occasion of Vijaydasami. I  may not be able to clarify you regarding commutation arrears.                              But I would like to suggest you to write to mrs Nirmala sitharaman , honorable Finance minister telling her the hardships undergone by one lac ladies drawing family pension ,which is a small amount. It may kindly be enhanced at par with RBI family pensioners at an early date .
You may appeal her by e mail and also by letter posted to her postal address.
Kindly suggest any other family pensioner , of any bank.

Where is the accountability?At what levels and who can fix accountability?,Every body will  transfer the bucks from to to lower level .That is why the banking industry is in very bad shape and what ever profits are earned are eaten by Npas.The unions are colliding with top executives and deriving the banks to loss making banks. The political power is playing havoc with im the loans sanctions to big corporate bodies and they get funding for their elections .The banking industry is reeling in vicious circle .It is very difficult to repair the system .As for as retirees are concerned we have to get the justice and legally eligible benefits through court orders. The irony is the banks officials are playing mischief and don't implement the court order to all .This is the hight of audacity by concerned authorities which is to be brought to books by associations and see that culprits are punished and justice is delivered. It is in this direction the SBM commune members and their leadership is moving .The partial  results are witnessed as trailer and abhi the picture baki hai.We are curiously waiting for the quick release of picture and the director Shri  C.N. Prasad is working hard for early release of benefits to all eligible beneficiaries.

Sir, has the issue of 37.2.b da finished or alive, Is there any chance for the poor retirees. Because only this solution can help all pensioners due to good increase in monthly pension also.

SBM pensioners other than petitioners are not paid arrears, forget about other bank pensioners. IBA is mighter than SC.

Shri C.N.Prasad the general secretary of SBM commune is taking required steps to get  the benefits to all eligible beneficiaries. It is a question of time. We will fight till Supreme court order is totally implemented.
