REPORT ON COURT CASES IN CITY CIVIL COURT, BANGALORE – PENSION ISSUES
We are enclosing herewith a list of 201 members from ING Vysya Bank for whom we have filed the following cases:
OS 8105 OF 2004 - 27 members
OS 3848 OF 2011 - 54 members
OS 3988 OF 2015 - 120 members
In this connection, we wish to inform you that in respect of OS 8105 of 2004, for a period of 14 years, C B R E A has been relentlessly pursuing the case despite the management repeatedly dragging up the issue. One Executive of the Bank, Sri Subramanya Gupta from Pension Fund appeared before the Court for cross examination and from our side 4 witnesses deposed. Sri Sivaji – retired officer and member from Guntur was one among the witnesses from our side. The submissions, documentary and oral evidence runs into nearly 1500 pages. During the interim period of running the case, Vysya Bank became ING Vysya Bank and now Kotak Bank has come into picture. We have made Kotak Bank a party in the place ING Vysya Bank.
We are happy to inform you that arguments from our side and from Kotak Bank were completed. The Kotak Bank engaged a senior counsel and from our side a senior counsel from Madras High Court appeared and argued on our behalf. The bank is fighting all out. The meticulous efforts put in by your Association all these years in attaining the near finality of the case are widely known to members and to those closely associated with us. Members need to realize that it is not easy to fight a bank having a battalion of lawyers and resources. We have left no stone unturned. For more details please read the attachment......
