Dear Friends,
 
I have joined this group recently on the advise by my colleague and found the communication  very informative and helpful to the retired bank employees who do not have any legally registered union to raise their issue & to fight their rights as all the bank unions are working for the interest of active employees only who gives the subscription during their life time and forgotten afterwards.
 
I took VRS from SBI in 2001 after completing 18 years 4 months service in the bank. All those SBI Employees having less than 20 years service were denied the Pension benfit on the plea that SBI Pension rules are different than Bank Industry Pension Rules.   We are fighting with the bank to make them understand that this VRS was brought by Govt of India to restructure Manpower and was to be implemented across the industry with the benefits available to employees on normal retirement along with some extra incentive.
 
Can any member help us (we are around 100-120 employees all over india) to take up our case with higher authorities or guide us in the matter or you can share any judgement similar to our case.  We will be very greatful to this group.

Dear Mr.Kalia & Madam Usha Gopalan,
In non-Sbi Banks, all those who had rendered 15yrs of service were given VR-Pension in 2001 under their respective Pension Regulations of 1995. In the case Venkatramani Vs Indian Bank, the Supreme Court upheld the Madras High court's orders to grant pension eventhough Mr.Venkatramani rendered only 14yrs 9mths and 17days(broken period of more than 6 months was taken as one year). But I am not aware of SBI-Pension Regulations!

In my opinion bank had asked the detail for payment of pension from all staff eligible for pension at the time of acceptance of application of VRS and before relief from bank.

In your case whether pension offer was given or not while informing the acceptance or before relief. If information would have given before relief as not eligible for pension you could have taken decision for continuing job by requesting bank for cancellation of your VRS application.

In case nothing was informed or mentioned regarding denial of pension or the same was informed after relief only. This may be taken as lapses of important information by the bank since the same is related to the life and future of survival of retiree staff. 

I hope this point can be taken for demand of pension.

In nationalised bank option was taken from staff for acceptance of pension or continueing  contributory PF, but in SBI probably all staff were automatically  eligible for pension.
