You are correct in this Point. If so,why do we allow different wage structures and  names for workmen in PSB, SBI and RBI. We are aware the Salary structure of SBI is always ahead of PSB employees and So RBI  employees mych more than SBI.  Only after PSB wage is settled, SBI starts its Negotiation as it is Easy and so RBI.  Every leader is a part of this Discrepancy for All Bipartite settlements . Not questioning anything. Then what genuineness is there to ask parity in Pension and Updation. Whether these things happened accidentally or  coincidence or  any other unknown Consideration for the leaders.  Nothing is Sure. I pray  atleast we get Updation with arrears from the Last Bipartite date, which itself will be  Boon.

The observation that RBI has revised/ not updated , whatever way it may be
called the out come of benefits are same. People used say Call me “ but
pay me Forty” call me in any way but give what I am entitled to!??

Yes. A general common sense approach equity of justice is the main basis
for our fight and let us hope for the best. The exact wording of pension
regulations clause 35(1) with annnexure1 and the amendment become
irrelevant if it is so. How the Pnb is going to defend ?

Considering the many elite learned veterans of this August body of lions
without teeth ( including myself) it is like an very old lion unable to
hunt making roaring sound by pressing its mouth on the earth and the sound
vibration being all over the forest, some goats lambs shamble across
running here and there in all directions , it happens that one or two may
fall on the open mouth of the hungry Lion. Here lions are roaring!!

Hon.Hon. Judges of the SC in Civil Appeal 7993/23 posed a question to both
petitioners' and respondents' advocates: What is your interpretation of Reg
35/1?
Both Dhruv Mehta and the Pensioners' advocates have given their
interpretations,
Therefore, the Hon'ble Judges will issue their final legal interpretation.
We can support the IBA or pensioners as per our pre disposition of the
issue.
I will better wait for the judges' verdict instead of giving my legal
opinion.

Without entering into the question of theapplicability of these constitutional provisions to the Singla case, maywe request you to enlighten us on a different but equally important issue.
 
Why are these very same constitutional principles notbeing applied within the banking industry itself, particularly among the PublicSector Banks?
 
Workmen and Officers across these banks perform thesame or substantially similar functions. Many of us were recruited through thevery same recruitment process. We belong to the same banking industry, arerepresented by the same Apex Organisations, and are governed by the sameBipartite Settlements and Joint Notes.
 
If that is so, why is there discrimination? Why isthere no equity or equality? Why are the principles of natural justiceconspicuously absent within our own industry?
 
If equality before the law is the governing principle,what prevents us from demanding equal treatment for all bank pensioners? Morespecifically, what prevents us from demanding compensation, in the form ofpension revision, for retirees of banks other than the State Bank of India,so as to remove the disparity that has persisted for decades?
 
We seek an answer not only from you, but from all ofus. Why are we not collectively raising our voice to demand equal treatmentwithin the banking industry? Should bank pensioners and retirees themselvesadvocate differential treatment for one section while remaining silent aboutdiscrimination against another?
 
Perhaps, the silence on this issue speaks louder thanwords.

The debate is about pending pension updation case before supreme court which on fast track for final verdict which is going to be in our favour based on the principles of Natural justice and jurisprudence and equity and equality of law under article 14 and16 and 21 of the constitution of India.
The judges shall exercise their constitutional authority to restore justice and apply their jurisdiction and jurisprudence and deliver the judgement in favour of petitioners.
Let us wait for final verdict.

Many believe that annexure 1 should have been updated in every bipartite
settlement as the emphatic wordsshall and formulae ( as amended in 2003, a
decade after 1993 pensioners regulations.and more over the period 1986 and
1993 retired are already done before amendment came in 2003. It therefore
implies for future Retirees as well from time to time.
The absence of formulae being added for various Bipartite covered Retirees
is an administrative error!!??
So wherever applicable in the clause is presumed as every Bipartite !!!
The present question hangs on whether there is perpetuity indication of
the amendment?? The judges have called for affidavits on the stand of Pnb
with all supporting evidence of various Bipartite settlements office
notes etc
So we are trying to stand on a flimsy support needing structural
restrengthening!!??
Let the judges take the view of the petitioners on equity law of justice
and decree in our favor at least prospectively.

If BMS has got good access to MOF and getting things done for RBI retirees
and have askedAIRBF ( paper tiger) to join why this AirbF is reluctant.
