Circular no 20-26

Date: February 18, 2026.

For circulation among members of the Governing Council, State Secretaries, Special Invitees, Advisors, Affiliates, Constituents of CBPRO and Members.

Dear Comrade,

Sub: Updates on M.C. Singla case on Pension Updation pending before the Supreme Court of India.

Com. K.V. Acharya, President of AIBPARC and Joint Convenor, CBPRO has received the following message from our Advocate, Shri Sewaram:

Quote:

CA number 7993/2023: M.C. Singla Vs UOI: the Division Bench no 2 consisting

of Hon'ble Mr. Justices Vikram Nath and Sandeep Mehta had part heard the matter and it was directed to be listed on 18.02.2026. That, however, as per the cause list for 18.02.2026, Hon'ble Court 2 shall consist of three Judges namely HMJ Vikram Nath, HMJ Sandeep Mehta and HMJ N.V Anjaria. Hence, our matter is not listed as it has to be listed before two judges Bench. If all the three judge Bench matters listed in the Court no 2 on 18.02.2026 are heard on that day, then there is a possibility that our matter may come up on 19.02.2026 or otherwise we may have to wait for the hearing list for 25/26 February, 2026.

In the meantime, on 16.02.2026, we are filing the documents as directed in the order dated 05.02.2026.

Text of the next message of Shri Sewaram (17.02.2026):

The supplementary list for regular matters for Courts for 18.02.2026 has been issued. There is no supplementary list for Court no 2. Hence M.C. Singla matter will not come up for hearing on 18.02.2026.

Text of message received from Shri Sewaram today (18th February 2026)

“The Supreme Court regular matter list for h earing on 19.2.26 has been issued. court no.2 will consist of full bench of three judges and as such MC Singla case is not listed on 19.2.26. now we shall await for list of 25/26 Feb. 2026.The matter may be listed on 25/26 February, 2026. please also note that supreme court shall be

closed from 28th Feb. 2026 to 8th march 2026 for Holi vacations.”

Unquote

As far as our Affiliate ARISE is concerned, the documents sought by the Hon'ble Court were filed on 16th February itself. On behalf of Petitioners AIPNBROA and Others also the documents are filed.

Any further development in this regard will be duly advised to members.

With Best Wishes and Regards,

Comradely yours,

Asked AI at around 10 p.m: Q and A.
M.C.Singla vs Union of India (Civil Appear No.7993/2023). The said case was supposed to be heard by the Supreme Court today the 18th February 2026. Can you give me an update about the proceedings of the case?

I've looked into the case of M.C. Singla vs. Union of India (Civil Appeal No. 7993/2023) for you. Unfortunately, I cannot provide a specific update on its proceedings for today, February 18, 2026. The publicly available information I can access does not include a record of this particular case being heard.

So, the suspense is extended. We have enough time to debate further, which direction the case will take to its ultimate conclusion ☺️

Even if the case is listed on 18th Feb it would have been adjourned.
I have predicted earlier that iBA will seek adjournment giving some reason or other. But some of my friends have commented that all data  is at the fingertips of IBA, why will IBA take adjournmentIt It will easily submit documents. Now all Pensioners groups have submitted charts well before fixed date of hearing, but IBA has not so far adhered to court directions.
Whenever the M C Singla case seems to be moving forward IBA seeks adjournment. We are aware IBA appointed a committee to study feasibility of 100$ DA and Updation and eminent persons were members of the committee. This committee consulted Both officers and workmen associations leaders. Committee would have submitted a report to IBA, which was not made public. After IBA filed affidavit without any iota of evidence, petitioners requested the Court to direct IBA to submit report to the court. Then IBA claimed the committee was dissolved and a new committee was being constituted and requested 3 months time to submit the report. But never submitted a report.
Now. had they submitted the charts as directed by Hon.Judge Vikramnath. at least some verdict one way or the other would have been possible. Even if the next hearing is scheduled during the March they will come and seek time to prepare chart claiming Banks are busy in year end work.
