PENSIONERS DAY ON 17th DECEMBER.

Pensioners Day is observed by Service pensioners in India on 17th December because Supreme Court of India pronounced its landmark judgement in D S Nakara vs. GOI case on 17th December 1982.

A Bench of SCI consisting of Chief Justice Mr. Y.V Chandrachud, J. Mr. DA Desai, J. Mr. O Chinnappa Reddy, J. Mr. V D Tulzapurkar and J. Mr. Bahrul Islam delivered the classic judgement which is relevant today, even after 38 years.

Court said:

"Pension  is a	right; not  a bounty  or  gratuitous
payment. The  payment of  pension does	not depend  upon the
discretion of  the Government  but is  governed by the rules
and a  government  servant  coming  within  those  rules  is
entitled to claim pension"

IBA/UFBu also applied Nakara judgment as follows for Bank Pensioners

' Pension is abounty and Ex gratia payment. Payment of pension depends upon discretion of IBA and UFBU and not on  rules."
