Dear Sir,
 
I worked in Dena Bank (PSU Bank) for 23 years and 3 months. Voluntarily retired/ resigned in Sep 2007 as a Senior Manager MMG-III faculty in Mumbai. I have received my PF + Banks PF and Gratuity of Rs.3.50 lacs after a gap of 4 months without interest.
 
I had opted for pension in 1993 when it was introduced. Subsequently second option came in 1995 Dec / Jan 1996. I was induced by Association and other fellow colleagues to revert back to PF which I did in Jan 1996. However, I withdrawn my PF option again in the same week and intended to continue in Pension.My pf contribution was transferred to pension fund in 1996.
 
I was continued to in Pension as i used to receive my PF statement my option was shown as pension optee. I applied for non refundable housing loan from PF Balance. At that time also they informed in writing I was pension optee hence i will get 50% of my own contribution.
 
Suddently post VRS the pension option became more attractive and bank took head count and in 2001 they informed me that I had withdrawn from Pension hence they credited the amount of banks contribution to my account. I took up the matter with PF Dept of Dena Bank through the controllers. They maintained the same stand stating that I had withdrawn. Evey time i used to receive the statement of PF i used to take up the matter with PF Dept.
 
I did not take up the matter with court of law as I was serving in the Bank I did not want to make chances of promotion bleak by fighting against the bank. Secondly I thought the demand of unions may come true and i may get the pension by default.
 
Having no option other to resign for personal reasons I tendered my offer to reliquinsh the job. Management accepted the offer gave me 50% of balance PL encashment, 480 days SL lapsed. I had to give back 77 days pay for short fall in notice.
 
After that i received my provident amount with bank;s and gratuity.
 
Now pension scheme came with retrospective date. I assumed that i will get the option but now am told that i am not entitled for that.
 
What is my stand now. What should i do? Can this association help me. I met a NGO on net they refused stating that it is more than 2 years hence cannot be fought.
 
I feel cheated for having got just paltry PF amount after 23 years.I was outstanding performer in the Bank. I got promotions in fast track whenever they were due.  Having appreciation from , AGM/RM /GM ,CMD of the Bank for consistent contribution in the field of recovery of NPAs and dedication and involvement.
 
Can you please guide me and take up my case.I have enough documentary proofs with me.

    I feel your case is genuine. many of our bank employees were misled by unions that PF optees get more than pension optees. to our dismay some of those union leaders in their personal opting , they opted for pension. it is unfortunate situation for employees.
I am not legally expert, you may contact chandrasekhar belsare who has formed a website for the exclusive benefit of bank resignees.his id is crbe...@gmail.com and the site is
  nowadays fighting individually in a court of law is very much expensive, so some of the resignees may consider the idea of forming bank resignees group exclusively for legal fighting, and if necessary ask /pray the court for stay of the second option until the bank managements/IBA include the bank resignees in the eligible criteria along with others.
Resignation is not sin,  if no allegations are on the employee. it is honourable exit. and it amounts to voluntary retiement. I think the present unions may not help the resignees.
Resignees are requested not to mention the job done after resignation unless it is a good rewarding job. instances are there many resignees after working in a PSU bank work privately to make both ends meet. So no necessity of mentioning the second job, mentioning it may harm the cause.  there is no alternative except legal fighting.this is not to cause the interests of bank employees waiting eagerly for second option. BUT THIS IS RIGHT TIME FOR THE BANK RESIGNEES TO KNOCK THE DOORS OF JUDICIARY BY FILING WRIT THROUGH ABLE ADVOCATE. STRIKE THE IRON WHILE IT IS HOT.
the above is only illustrative, but not exhaustive. you resignees get together , discuss and gather all relevant points, the injustice done to the resignees and also the central govt treating its employees. it is heard that after a length of service, the resigned central govt employees are getting proportionate pension. So all the more need of advocate knowing central govt regulations and 6th pay commission recommendations etc., in addition to bank resignees points.
