Dear  Mr. Badi & other Friends,

Lot of confusion is prevailing over the jurisdiction of CAT. Though Mr. Prasad  has already  clarified with the quotation of the ACT, Yet I am giving hereunder the services covered by the CAT which will further clear any mist in the matter and there will remain no ambiguity now.

Banking services are not covered by the CAT as these service do not come under the purview of CAT. Pl do not confuse MOF as the MOF is related to ministerial employees of ministery of finance.

Dear Sir,

I also agree with the view that the employees of Banks, are at
present, not under the jurisdiction of CAT.

But may be covered shortly subject to improvement of the
infrastructure in CAT, by the government.

Please find enclosed herewith an article which is self explanatory and
reveals that the employees of PSU banks were not under the purview of
CAT. But may come subject to improvement of infrastructure in CAT, by
the government in future.

EMPLOYEES of public sector undertakings or PSUs including those
working in government banks may finally be able to approach Central
Administrative Tribunal (CAT) for justice in matters of recruitment
and conditions of service if the government succeeds in installing
better infrastructure in CAT. While talking at All India Conference of
CAT in New Delhi on Sunday, minister of state for personnel, public
grievances and pensions Prithviraj Chavan (See picture) said, "More
government employees would be in a position to get speedy justice for
their grievances. If we can fulfil the infrastructure needs of CAT,
even the PSUs and the Public Sector Banking institutions could be
covered."

Currently, 191 organisations of the Central government come under the
ambit of CAT which has so far handled about 5.32 lakh cases out of
which only about 23,000 cases are pending.

While inaugurating the conference, Chief Justice of India KG
Balakrishnan said that CAT had progressively improved their disposal
in recent years and some regional benches disposed off a higher number
of cases than the numbers instituted before them.

Chairman of Principal Bench CAT Justice VK Bali informed the gathering
that 91% of cases of the principal bench were upheld in the writ
petitions in Delhi High Court. "We have decided it as a matter of
policy that life of no case in the tribunal in any part of the country
would be more than six months", he added.

So, Bank employees may come under CAT jurisdiction, in future and not
now.

Dear   Sir,

Every time  the Bank Managements /  IBA  for any benefit or for salary revision,  requires the permission of  Finance Ministry.  Recently for the Gratuity Issue,  only Finance Ministry ruled against payment since 1.1.2006 for the Banking sector. Restriction for promotions also being issued by Finance Ministry. .  In that case why not  CAT  is inapplicable to Banks.  Please refer item No.B-15 - Other services regulated by Central Government, furnished by Mr.Gulati..  Can anyone explain?

The  pension regulations was signed by relevant parties and approved by Central government during 1995 and amendment was done by each and every bank and became a law. That means all provisions/benefits  contained in pension regulations are already approved by Central government.
Calculating Basic pension taking into account last 10 months of service was one of such provisions contained in that regulation. While it is already approved by central government what is the need of taking Central governments permission again ? 
AIBOC in its  letter to IBA during Sep 2011  while requesting for early implementation of 
Chennai High Court verdict suggested to IBA to take Central government permission.
Is it proper to suggest that?

Dear Sir,

Yes, you are correct. Here the point is whether the bank employees are
under the jurisdiction of CAT ?

For that, I got this article which gives clarity for the current
problem. After this date there is announcement either from CAT or
government or banks regarding the coverage of bank employees under the
jurisdiction of CAT, as per my knowledge and verification.

Dear Sir,

When the central minister of state for personnel, public grievances
and pensions has declared in a public meeting of all india conference
of CAT, that bank employees may be covered in future subject to
providing infrastructure in CAT, why should we have doubt about it.
And there is no further announcement regarding inclusion of bank
employees under the jurisdiction of CAT.

Point 15-B : finance means employees in the ministry of finance etc.,
and not bank employees.

Dear Sir,

If AIBOC has suggested IBA to take government permission for
implementing Chennai High Court verdict, it is not at all proper on
its part and nothing but over action. It is none of its business
whether IBA is going to take permission or not. Only thing it has to
do is demanding for implementation of court orders immediately and
instantly. It is the head ache of IBA to take a decision of the issue.

Still, nothing has come so far.

Let us hope for early decision from IBA and implementation by all
banks.

Dear Mr. Karunakaran,
I do not understand,  why my friend is  still confused? Other services at point (B)  have been mentioned serial-wise. Other services should not be read with a different meaning that this includes other than those mentioned here. If other services had not been elaborately mentioned, then certainly need for some clarification would have arisen. So, sir, there is no ambiguity left. Let us wish &  hope, banking services are brought within the ambit of CAT, which is still a distant dream.
I hope this will satisfy my friend in understanding the whole gamut of confusion.

Dear Shri Somasekar,
Each and every decision on personnel policy matters of financial implications requires the prior or post-facto(pertaining to SBI only) approval of Banking Division of MOF.
When RBI/LIC Boards approved revision of pension , MOF rejected it citing frivolous reasons vide their site airbiopf. Despite Verdicts of 2 High Courts, pensioners of RBI/LIC yet to get the revision.

The  pension regulations was signed by relevant parties and approved by Central government during 1995 and amendment was done by each and every bank and became a law. That means all provisions/benefits  contained in pension regulations are already approved by Central government.
Calculating Basic pension taking into account last 10 months of service was one of such provisions contained in that regulation. While it is already approved by central government what is the need of taking Central governments permission again ? 
AIBOC in its  letter to IBA during Sep 2011  while requesting for early implementation of 
Chennai High Court verdict suggested to IBA to take Central government permission.
Is it proper to suggest that?

THE COURT HAS ALREADY GIVEN THE VERDICT. THE CENTRAL GOVT. HAS NOTHING TO DO WITH THE COURT VERDICT. IT HAS TO OBEY THE COURT ORDER OR TO APPEAL WITH VALID REASONS IN THE SUPREME COURT.    AIBOC  BY ITS LETTER  KINDLES THE IBA TO ADOPT THE TACTIC OF GOVT. PERMISSION AND GO SLOW. DEFINITELY THERE WILL BE SOME BENEFIT FOR THEM TO WRITE SUCH A LETTER.   AFTER ALL EVEN IF THE ARREARS PAID IN 2011  OR IN 2021, THEY ARE NOT GOING TO PAY ANY INTEREST. 

I THINK THAT THERE IS NO ONE TO TEACH LAW OR HUMANITY TO THE SUPER SENIOR UNION LEADERS.
