Help resignee-pensioners to have a fair deal

Respected AIBOC General Secretary Sir,

Sub: resignee-pensioners need your help again

Thank a lot and lot  to AIBOC for getting pension to resignees with qualified service of 20 years or more.  As an ex-member of AIBOC, I take the liberty to write this direct email.    As a member of new generation of resignee-pensioners, I humbly represent following for favorable consideration of and escalation to IBA to communicate the clarifications to Banks:

Please consider this as a representation on behalf of resignee-pensioners.

Background: eligible resignees are paid pension (1)  "without"   monthly pension ex gratia (2) "without" additional 5 years of service to compute basic pension.

This representation is based on following points, which may not be exhaustive:

1. Eligible resignees are now within the scope of Bank Employees Pension Regulations 1995 as per Ministry of Finance, GOI letter dated 16.march.2024 and subsequent amendment to the Regulations by respective Banks.

2. The abovementioned GOI approval dated 16.march.2024 and Amended Regulations " excluded"  commutation and retrospective effect of pension payment to resignees.  It does not "exclude" addition of 5 years ro qualified service and neither prospective monthly ex-gratia pension payments.

3. Amended Regulations stipulates -pension will be computed as applicable to relevant BPS/Note. So, resignees are " not" given basic pension based on the latest BPS and are fit in in relevant BPS.  So,  is it NOT unfair and is it not double-standard to deny monthly pension ex-gratia? . In case of resignee-pensioners, notional basic pay can be taken as basic pay as of OCT-2022 and that's within the scopes of relevant BPS/Note because the same treatment is given for DR to compute for ex-gratia for pre-2002 pensioners. 

To reiterate, commutation and retrospective effect are excluded as per settlement/MOU.  There was "no" exclusion for payment of ex gratia and addition of 5 years to qualified service as well.  Still, banks may be waiting for specific communication from IBA.

Humble request, please escalate to IBA to direct Banks on these two points and  help resignee-members to have a fair deal.

We must include resignees to whom bank not paid BCF ,(Bank Contribution to PF ) at the time of resignation.

Pension must paid from date of resignation or restrospective date to above resignees.solid grounds is that bacouse there BCF already lying with bank.

 IBA /banks said in circular that pension will be start just after they return there's BCF in bank.
