Find below another letter shot by Mr.Nadaf to IBA. I'm glad that Mr General Secretary AIBOC is suddenly awake and is spending some precious time for bank pensioners.

100% DA NEUTRALISATION TO PENSIONERS

          The Pensioners in the Banking Industry have been getting pension on the basis of the Bipartite settlements right from 01.11.1993. We have been demanding 100% DA neutralization to all the pensioners /family pensioners who retired from service of the bank prior to 01.11.2002. You are aware of the fact that, 100% DA neutralization has been secured to the employees as well as pensioners with effect from 01.11.2002. However Reserve Bank of India has considered 100 % DA neutralization to all its employees retired / deceased prior to 01.11.2002. But, this is implemented wef., 01.02.2005. Our Pension Scheme is akin to the scheme available at RBI.

2.  We have today addressed a letter to IBA highlighting the need to extend 100% DA neutralization to pensioners and family pensioners in the banking industry who retired before 01.11.2002 on par with RBI scheme w.e.f.,  01.05.2005. The letter is annexed to this circular and is self-explicit.

 

3. Further developments in the matter will be informed.

100% DA NEUTRALISATION TO PENSIONERS

        We refer to Pension settlement between IBA & Unions in Banking Industry dated 29th October, 1993. 

 

2.      The Pension Scheme introduced in the Banking Industry w.e.f. 01.11.1993; was to be broadly based on central Govt./RBI pattern.

 

3.      Dearness relief to Pensioners will be granted at such rates as may be determined from time to time to fall in line with the “Dearness Allowance Formula in operation in Reserve Bank of India”, vide its Circular No. HRDD No 10139/21 -01/2007-08 dated 01.04.2008, with instructions for payment of Dearness Relief with cent percent neutralization for the entire pension amount to all its pensioners, retired beore 01.11.2002 with effect from 01.03.2008.

 

4.      Subsequently, in January 2010, the Reserve Bank of India issued instructions to all its offices to pay Dearness Relief to all its employees retired/deceased before 01.11.2002, with cent percent neutralistion for rise in CPI from the month of February 2005 to February 2008, vide its Circular No. CO HRDD No.6223/21 dated 01.09.2010 and 01.01.2010.

5.      100% D.A neutralization was extended to employees and pensioners in the Banking Industry, w.e.f. 01.11.2002. We therefore, request you to extend 100% D.A neutralization to pensioners and family pensioners who retired before 01.11.2002, at par with RBI Scheme w.e.f 01.05.2005

At least now we are getting the support of AIBOC AND AIBEA for getting 100% neutralisation of DA  to all pre 1/10/2002 retirees.Let us not criticise anybody and let us thank for whatever  AIBEA/AIBOC/UFBU HAS DONE AND THEY ARE DOING NOW.It is natural for them to fight for second option of existing employees since they were not entitled at all so far.Now that problem is settled  to certain extent,it is now time for the premier UNIONS IN THE BANKING INDUSTRY to fight for 100% DA NEUTRALISATION AND  UPDATION OF PENSION.

In 2005 retirees prior to 01.11.2002 were given arrears of pension due to the revision in Basic Pension on account of neutrilasation of DA from 1616 to 1684 points with effect from 01.05.2005. Now we ask for 100% DA neutralisation with effect from 01.05.2005. Does it mean that 1616 to 1684 is not 100% neutralisation? Can any one clarify?

Dear Sir,
You have mistaken MERGER of DA for 100% neutralization.
AS you said anamoly in the merger has been already removed but pensioners are paid higher basic wef 1.5.2005 instead of from 1/11/2002. Arrears for this period, increase in commutation are denied even after verdicts from High courts.
DA was paid at a tapered level to all (clerks/officers except sub-staff) till 1.5.2005. The same has been restored at 100% uniformly for all serving and pensioners. But this is not done inrespect of those who retired before 1/11/2002.
The monthly loss on a/c of this discrimination is more than Rs996/ (basic@6194). The ratio of loss is more for higher basic and for higher number of slabs.

THIS ISSUE of 100% Nuetralization of DA  HAS ALREADY BEEN CONSIDERED BY AIBRF LONG BACK AND THEY ARE PERUSING WITH IBA/GOVT SINCE LONG.IT WAS REPORTED IN THE LAST CC MEETING AT MANGLORE ON 17 & 18TH SEPT,11 , WHERE THE UNDERSIGNED HAVE PARTICIPATED,THAT THIS MATTER WILL BE SETTLED BY IBA SOON.

Dear Vijayaraghavan sir,
It is very simple. Pl assume that for every rise of ONE slab  if  ONE rupee is agreed to be paid to all, it is paid at the rate of only SEVENTY SIX paise to all those who retired before 1/11/2002.

Still the position is not clear. Higher pension should have been given from the date of retirement and not from either 01.11.2002 or 01.05.2005. Do u mean that even after merger of DA at 1684 points DA neutralisation at 100% was not given to retirees prior to 01.11.2002? Things are still quite unclear.

good morning. We are very happy to,listen to U after a long time. Whether U were to US/UK or elsewhere? I felt a lot for Ur absence. On 100% neutralization, when IBA agreed to settle the matter, it is a good news. We are equally happy that U r one of the participants. I am sure, with Ur participation, every retiree can pin his/her hopes on AIBRF for a remedy for the specific set of problems. Since, settling the problems with IBA and Govt. of India is the best option available to us through AIBRF.

Sir, Bank's lawyer kept on asking 15 days time on each hearing dates. Court is granting him time as our  HO is in Kolkata. Court has asked him whether is it possible to treat Badi as CRS( since he has attaind the age 62 years ) on 22.07.11. and court halls are changing and case is getting danced b4 three judges since last two months. I am Hence worried. Kindly advise me how my case will be decided.Thank you Sir for your kind concern. with regards.

YES,100% DA NEUTRALISATION IS NOT GIVEN TO PRE1/10/2002 RETIREES AND THAT IS ONE OF THE MAIN REASONS AS TO WHY THERE IS SUCH A HUGE DIFFERENCE  IN THE AMOUNT OF PENSION DRAWN BY SIMILARLY PLACED PEOPLE BUT SOME RETIRED BEFORE 1/10/2002 AND  OTHERS WHO RETIRED AFTER 1/10/2002.

In Banks where the benefit of notional addition of 5years is given, commutation of pension arrears is given. But commutation of pension arrears as well as pension arrears( upto 30.04.2005) arising out of the merger of DA 1684 points are not given on account of the agreement made in the 8th BPS.

Thanks for giving me an opportunity to explain the LOSS on DA neutralization.
On an averge of Rs1500/ every month total arrear works out to Rs 114000 (1500x76months).
Most of those who retired after 1/5/2005 are not aware of this discrimination.
This discrimination violates Article 14 and completely against the verdict of SC in NAKARA case.
In RBI, now this dicrimination is removed and the pre-2002 are to be paid arrears wef 1/5/2005. I hope LIC will follow soon.
So, in Banks(both sbi &non-sbi) the time has come to step up pressure on IBA through all the Unions.
 
MERGER of DA@1684:
Only arrears from 1/11/2002 to 30/4/2005 on 17 slabs to be paid. Arrear on commutable portion is not clear as some banks have paid and some have not paid during Nov-Dec2009 on restoring 5 years benefit.

Upto basic pay Rs6010 ------13.15rupees per slab                             on 648slabs DA is 648x18.63=12072.24
                                                                                    
Beyond6010 ie on basic of 1755 @0.06%=1.053
So Da on a basic of Rs7765x14.203
For 648 slabs, 648x14.203=9203.54                                      Net DA loss 12072-9203=2869 per month

If you can inform your basic(ie,basic pension+the commuted portion of basic), I can illustrate the LOSS you suffer everymonth.
 
100%Neutralization of DA:  Only sub-staff were paid 100% till 1/5/2005. All others got only tapered DA ie, all serving senior clerks to GM got DA at a decreasing rate of neutralization. Higher the basic pay, lower the rate of DA neutralization.
This anomaly was removed for serving staff wef 1/5/2005.For those who retired after 1/11/2002, DA on pension is calculated @100% neutrlalization wef 1/5/2005. Those pension-optees who retired after 1/5/2005 is paid @100%. Those PF-optees who became pensioners but retired after 1/11/2002 are also  paid @100% wef 1/5/2005. But those who retired before 1/11/2002 (irrespective of pension optee/superannuated/SVRS/PF turned pensioners) are being NOT paid DA@100% wef 1/5/2005 as is being paid to all others. This category, retired before 1/11/2002, are continously paid at a tapered rate  resulting in monthly loss of more than Rs1039- on a basic pension of Rs6194/
 
Tapered DA:                                                                                         DA @100%
Upto Rs 35...@o.24%= 8.52                                                  For entire 61...@0.24% =14.8656per slab
  next    21...@0.20%=   4.2
next    360@ 0.12% =     0.432                                                 For 648slabs   648x14.8656=9632.91  
 
 184@ 0.06%          =      0.11                                              
                                         -----
                                        13.26 per slab
DA for 648 slabs
 648x13.26=8593.78                                                            Monthly underpaid DA=9632.91-8593.78=1039.
The monthly loss will be higher for higher basic and every furher increase of slabs.
